    This is why you have policies that are unambiguous.

    Pay based on positions, so people don’t get favoritism. Performance based promotions with benchmarks and documentation. If one person works 80 hour weeks, better write that down. If someone is doing 40 next to them, write it down. Someone spreading lies throughout the office, write it down. Someone bad mouthing other employees, write it down. Date, sign, counsel them.

    Spell out sexual harassment rules and follow them. Zero tolerance for sexual assault.

    The one that is actually impossible to resolve is retaliation. Anyone can become your enemy and “retaliate” based on any perceived slight. And anyone can be fired for any reason so long as it doesn’t specifically break the law. Even then, they claim they are fired for insubordination or poor performance. Which can mean anything you want.

    /I mean, Riot is a big corporation owned by TENCENT with Lawyers and HR that should know better. What have then been doing?

      The issue with position based pay is that its not clear cut in most positions. Salary negotiations start at the interview process where the company is trying to get you for as cheap as possible. Two people getting paid differently for the same position with the same experience is extremely common. Only way around this is to mandate exact pay scales, and thats a horrible idea for obvious reasons.

      This is an excellent way to discriminate against people with families or those who are able to get their work done in a reasonable amount of time.

    When I was last applying for jobs I noticed a couple game companies making very overt suggestions that you, as a candidate, were expected to play games. Even for G&A roles that had little to do with games.

    I did think they might result in a disparate impact situation on gender discrimination or even age discrimination grounds, because numbers consistently show more men play games than women, and more young people than over 40.

      Bona Fide job requirements are an ironclad exception to disparate impact suits (see the caselaw about lifting requirements).  I think you can make a very strong case that “using our products, understanding our industry and competition” is a bona fide job requirement.  A shampoo company wouldn’t be discriminating if they didn’t hire bald people.

      Not anymore. Last study showed that the gap is huge in the 18-29 group (72% of men vs 49% of women), that gap is gone after that point and by age 50, more women play video games than men (in the 50-64 age group, its 34% of women v 29% of men). The only big difference overall is the likelihood to call oneself a “gamer”. Men hold that title, since only like 3% of women will do that.

    DFEH says that Riot has “impeded” the investigation by withholding “basic employment data that... employment laws require employers to maintain.” And Riot replies During this time, we’ve promptly responded to the DFEH’s requests, and have produced over 2,500 pages of documents and several thousand lines of pay data so far.

    Are we taking bets on if Riot pulled raw data from a variety of sources, put them all into a single CSV file where nothing would line up, and gave the DFEH a physical printed copy so that the data is technically correct but impossible to decipher in a timely fashion?
