    Whenever a cop is killed by a citizen, the media always (always) includes the word AMBUSHED.

    Clark was actually AMBUSHED and murdered by the cops in his own back yard, but you won’t hear them say that about “their heroes”.

    The Root didn’t brush over shit. Schubert put that speculation out there intentionally. If she had been in a court of law, she would have been called out for it. She cannot say with certainty what his mental state was.

    And remember, she did all of that to justify not charging the cops with his death.

    It’s amazing to me that we can send 18-19 year old kids to active combat zones and give them instructions that say ‘you cannot fire unless first fired upon,’ but when it comes to grown ass adults charged with ‘protecting lives’ inside our country the standard appears to be ‘it’s ok to unload your mag at someone if you’re moderately uncomfortable’

      You forget a couple of things:

      1. A lot of the folks who go into the the military do so because they like the thought of shooting big fucking guns.

      2. When they leave the military, they like the idea of joining the police, because, you know, it’s a state-side para-military organization (you see the vehicles these people have?).

      3. It generally takes more training to get to be a licensed hair stylist than it does to be a cop.

      4. The most important thing they teach the police is ‘draw your weapon’, because the only way to deal with a situation is to brandish arms.

      5. Cops learn early on that they can get away with a lot of shit you couldn’t get away with in most jobs, including the military. As such, they become more brazen with their attitudes towards anyone not a cop (hence why they have no problem punching cuffed suspects), and it just leads to more and more violent behavior.

      this all 100% true. Ive known a number of Army/Marine guys in my younger years and they all joined for the hope of going somewhere and shooting/murdering anyone they could. The murdering was the point.

      When our endless wars started in Iraq/Afghanistan i remember thinking that this will end up back home in even more militarized and traumatized police running rampant shooting up anything they see. Throw in our very racist society that has been murdering PoC for centuries and its all bad news.

      This is another in a long line of outrages and ppl really need to vote for the most leftwing candidate for every office from dog catcher to president. This DA is a killer.

    I’m struck by the argument that Clark approached them in a “shooting stance” which defies logic given that he had a cell phone in his hand. What black man in his right mind is going to approach the police in a shooting stance with no gun in their hand?

    The DA can argue that technically a crime wasn’t committed since it wasn’t premeditated like murder: but you can’t tell me that this doesn’t fit the description of negligent homicide, like when a drunk driver kills someone on the road. They didn’t get into the car intending to kill someone but they did.

    The same laws and precedents should hold for these police officers; otherwise, they are privileged to kill people at will and that is the antithesis of the rule of law. You can’t have special standards in civil law; this isn’t a war zone.

    As long as “use of force” laws are anchored to “reasonable fear” it will be difficult for DA to prosecute the police for executing unarmed citizens. It’s not enough to just protest we need to organize in a way that sustains the pressure required to change the laws that make it easy for lousy police to escape prosecution and hold AG’s accountable; raising money to buy local ads, social media campaigns, billboards, regular public protests at the Statehouse and DA’s office pushing for AB 392.

    California law gives officers broad discretion to employ deadly force against suspects if the officers believe they were in danger.

    CA PEN 835a. Any peace officer who has reasonable cause to believe that the person to be arrested has committed a public offense may use reasonable force to effect the arrest, to prevent escape or to overcome resistance.

    A peace officer who makes or attempts to make an arrest need not retreat or desist from his efforts by reason of the resistance or threatened resistance of the person being arrested; nor shall such officer be deemed an aggressor or lose his right to self-defense by the use of reasonable force to effect the arrest or to prevent escape or to overcome resistance.

    Californians have an opportunity to change that law this year by supporting AB 392 aka The California Act To Save Lives sponsored by, Assemblywoman Shirley Weber, D-San Diego, Assemblyman Kevin McCarty, D-Sacramento. AB 392 would permit the use of deadly force only when officers believe it’s necessary and there’s no viable alternative.

    Attorney General Xavier Becerra’s office is still reviewing the case. Time to turn the heat up on him. He’s more interested in grandstanding against Trump

    Becerra must decide whether he wants to rid the state’s police departments of bad cops, or enable them. And he must decide whether he will run his department with the integrity it deserves, or continue pandering to special interests.

    As for DA Schubert, unfortunately, she was re-elected last fall. Residents need to hold a public protest every week in front of her office reminding the public of her shit ass record and plaster the city with billboards.

    - The DA’s office hasn’t prosecuted an officer for a wrongful shooting of a civilian in at least 30 years

    - Declined to prosecute 33 cases since becoming DA in 2014

    - Received $13,000 in campaign donations from two police unions after Clark’s death that she was “proud to accept donations from the law enforcement community. She works with them every day.”

    Towards the end of her presser, she said “now is not the time to discuss legislation” because that’s what police unions fear the people making laws that will hold them accountable.

    It’s too bad the only people who get this amount of review are cops. The police could not even be bothered to identify themselves, let alone do anything except assume a vandal was going to be shooting them, so they shot first. 

    He was murdered, plain and simple. If he had killed the two cops, would we be hear today hearing how he was justified after a long review of evidence, or would he have already been tried for murder?

    The public are expected to observe every rule and law and command of the police.  Nothing really seems to be expected of police.

    The whole fucking press conference was a sham. The DA spent most of the time painting Stephon as the aggressor, rather than the victim. It was very much as if he was on trial, not the two dudes who murdered him.
