    A person is guilty of falsely reporting an incident in the third degree when, knowing the information reported, conveyed or circulated to be false or baseless, he or she:

    1. Initiates or circulates a false report or warning of an alleged occurrence or impending occurrence of a crime, catastrophe or emergency under circumstances in which it is not unlikely that public alarm or inconvenience will result; or

    2. Reports, by word or action, to an official or quasi-official agency or organization having the function of dealing with emergencies involving danger to life or property, an alleged occurrence or impending occurrence of a catastrophe or emergency which did not in fact occur or does not in fact exist; or

    3. Gratuitously reports to a law enforcement officer or agency (a) the alleged occurrence of an offense or incident which did not in fact occur; or (b) an allegedly impending occurrence of an offense or incident which in fact is not about to occur; or (c) false information relating to an actual offense or incident or to the alleged implication of some person therein; or

    4. Reports, by word or action, an alleged occurrence or condition of child abuse or maltreatment or abuse or neglect of a vulnerable person which did not in fact occur or exist to:

    (a) the statewide central register of child abuse and maltreatment, as defined in title six of article six of the social services law or the vulnerable persons’ central register as defined in article eleven of such law, or

    (b) any person required to report cases of suspected child abuse or maltreatment pursuant to subdivision one of section four hundred thirteen of the social services law or to report cases of suspected abuse or neglect of a vulnerable person pursuant to section four hundred ninety-one of such law, knowing that the person is required to report such cases, and with the intent that such an alleged occurrence be reported to the statewide central register or vulnerable persons’ central register.

    Falsely reporting an incident in the third degree is a class A misdemeanor.

    Could it be that prosecutors haven’t charged under 3? Curious as to what kind of sentencing he would recommend.

      I’m like, uh, what good are new laws when police show not the slightest inclination for observing existing ones and applying them arbitrarily and unaccountably when they do?

      Obviously a great idea and I hope they still do it but

      A) really hope nobody’s expecting a magic bullet solution, or many prosecutions

      B) there’s already avenues for this, kind of

      C) the police are taking ZERO accountability for responding to trivial, nonsensical and trivial matters

    You can hear the wails of complaints now. “But if I could be charged, I’d have to think first about whether this person is threatening or I’m just feeling threatened by that doo-rag and low-hanging pants. And what happens if they then pull out a gun and kill me, and now I can’t call 911 because I thought about it for 5 seconds? So now I’m going to get myself a concealed carry permit so I can just shoot down anyone who I feel is threatening me and you can be sure I’ll proclaim loudly that I stood my ground! All because you won’t let me call the police because I’m not sure that woman and her kids showered before they got in the pool. Actually, i’m not sure she’s even a resident. Sure, I’ve seen her daily leaving an apartment in the complex, and her car’s right over there, but is she really a tenant? Hello, 911.....”

    Fuck, start by making it illegal to call the cops to use them as customer service by reporting shit that isn’t a serious crime. You wanna report something like operating without a permit? Go to the applicable city agency like reasonable people.

    He's absolutely right. But I do worry about unintended consequences. Not like white woman tears consquences. But like incentive to say there is a weapon consquences. Or somehow being twisted and used against black women experiencing domestic violence. Basically, I don't really trust the police.

    Under ordinary circumstances, I’d disagree. But these are clearly people employing racially motivated attacks, using armed (and often trigger-happy) police officers to do the dirty work for them. So, yes, this kind of bullshit should absolutely qualify as a hate crime.

      Except that Jesse Hamilton is a member of the IDC, a breakout group of democrats who have canvassed with the Republicans for years. The Dems do not have the majority in the NYS Senate.

      While the IDC “disbanded” New Yorkers are holding its members accountable for helping the GOP kill progressive legislation. Hamilton and his IDC collaegues blocked legislation on reproductive health issues, DREAM, affordable housing, etc.

      He is currently being challenged by Zellnor Myrie. I’d bet this is just an insincere gesture which he is using to try and change the narrative around his actual history as an elected when September’s primaries come.
