      ALBANY, N.Y. - New York Gov. David Paterson commuted the sentence Thursday of a black man imprisoned for the racially charged shooting death of a white teenager on Long Island, a decision in the final days of his administration that infuriated the lawyer who prosecuted the case.

      Paterson said the five months John Harris White has served was enough time for the emotion-fueled 2006 shooting death of Daniel Cicciaro, 17. Paterson said everybody connected with the case had suffered enough, and White was released Thursday.

      White teenagers were feuding with John White’s 19-year-old son when they went by the carload to their home in August 2006. White was convicted of manslaughter for shooting one of the teenagers at the foot of White’s driveway, in what he referred to as a lynch mob.

      A judge sentenced White to two to four years in prison, a fraction of the maximum, exactly four years ago Thursday. He finally went to prison in July this year after his appeals were rejected.

      White arrived at his home early Thursday afternoon.

      “Merry Christmas,” said a smiling White, according to the New York Daily News. “I’m definitely glad to be home with my family for Christmas, and I hope everyone has a pleasant and happy holiday.”

      “He is happy to be spending this very special Christmas with his family,” said White’s lawyer, Paul Gianelli. He wouldn’t say whether White had sought a pardon.

      “The only thing that matters right now is his personal liberty and his ability to rejoin his family,” Gianelli said. “The case is finished. It’s over and done with.”

      Suffolk County District Attorney Thomas J. Spota blasted Paterson for the way he handled his decision.

      “I strongly believe the governor should have had the decency and the compassion to at least contact the victim’s family to allow them to be heard before commuting the defendant’s sentence,” Spota said.

      “Our hearts go out to the Cicciaro family for the loss of their loved one,” said NAACP President Benjamin Todd Jealous. “This act of commutation shows the value of local people getting involved, raising their voice for justice and keeping the faith.” The National Association for the Advancement of Colored People sought a full pardon.

    I respect where he’s coming from but he shouldn’t have put that out there for two reasons:

    1. SYG has a tendencey to work against black people, not for us.

    2. By announcing your intentions, you might be giving the racists exactly what they want, a confrontation and an opportunity to stand “their”ground.

      Right, very much like with Marissa Alexander, and that case is just a stew of “would have, should have, everybody damn said”.

      So far as I can recall on last reading - she went to car to grab gun and came back, which doesn’t fit SYG, because she could have retreated, but he had locked the garage, so she couldn’t get out... so then it did. She had fired a warning shot and there was a documented history of abuse, but she fired it into a wall or ceiling and there were kids in the house, but also she had given birth 9 (just 9 damn days before) and was trying to collect stuff. Some of the kids in the house were from his previous relationships, in which he was also apparently documented as abusive.

      As much as I would love for nobody to hit their partner, guns not to be fired in houses with children, 9 days after birth and you try some shit?! You are a stupid ass motherfucker, and you should be glad it was a warning shot.

      One more comment before the citation drop; White women, Latina/Native descended women, Asian women ect*, have all had to deal with this shit too. Does that make the violence and the ignoring of violence against Black other appropriate orgs. This is one area though, where all women ought to work together.

      *Very much not trying to leave people out.

      Okay, I’m going to give you all this -

      “Marissa Alexander’s incarceration: Despite the fact that Marissa Alexander caused no injuries and has no previous criminal record, and despite the fact that Florida’s self-defense law includes the right to “Stand Your Ground,” she was arrested by Jacksonville police and charged with aggravated assault. She rejected a 3 year plea bargain because maintained her innocence and right to defend her life. After 12 minutes of deliberation, a jury of 6 people convicted Ms. Alexander of three counts of aggravated assault with a deadly weapon with no intent to harm. Her sentence was set at 20 years in part due to the state’s mandatory minimum sentencing laws. Marissa Alexander successfully appealed the trial, overturning the guilty verdict on 9/26/13. She was released on bond on 11/27/13 and is now under home detention. While under home detention, she must pay $105 every week for the use of an ankle monitor, and $500 every other week for the bond cost. If she had been found guilty in a new trial, she faced a tripled mandatory sentence of 60 years for self-defense.”

      I heard about Marissa. I didn’t know that she successfully appealed. Not that she’s any better off for it. She basically went from the being in the pen to being in debtor’s prison. If I added that up right, she’s paying the state about $1420/month, and for what? This has to qualify as some kind of cruel and unusual punishment.
