Lawsuits like these need to hit morons who file them harder than any monetary amount they may have hoped to recover. People should NOT be free to sue on a whim. There needs to be a legitimate, identifiable reason to do so. Lawsuits that are CLEARLY not filed in good faith (like this one), should not only be cause for the lawyers involved to be disbarred, but for massive fines to be levied against the plaintiff far above and beyond the ‘costs’ of the suit itself.

A clear message needs to be sent — the courts are nobody’s personal playground. And anyone who attempts to act otherwise won’t be doing it for long.

Many states have laws for this, I believe West Virginia does not.

Speaking of clear messages, would it be a conflicting message if Santa left coal in Bob Murray’s Christmas stocking? Since coal is a good thing, would that indicate that Mr. Murray has been naughty, or nice?

Might be too late for him to do it on the show this weekend depending on what they have planned, but I’m curious to hear what he has to say about this. I remember seeing him in an interview where he appeared to be desperate to do so and was implying that things behind the scenes were truly batshit, but the lawyers wanted him to keep quiet for the moment until they got it tossed.

Fun legal fact: truth is not always a defense against defamation. In some cases private citizens have won a defamation case against a corporation because true information was released “with malice”.

A worker at Staples was caught padding his expense reports and was fired. The company widely circulated a memo detailing his actions and firing. The court found that the unusual circulation of the information constituted malicious defamation even though it was true.

I suppose it’s a fine line between satire and malice, huh?

This just isn’t a good year for Bob Murray. First, he fails to destroy Gotham with his army of penguins with rockets strapped to their backs, and now this.

Nice of the Judge to wait until he was back on the air to rule on this so we get to see Oliver’s reaction

“Uncle Bob” has already hit the roof about the ruling, and said he’d appeal it to the West Virginia Supreme Court. The man sues journalists and media like it’s a bodily function, and he’s had mixed results, from getting a newspaper in Northeast Ohio to stop writing about him, even scrubbing all references of him from their website. On the other hand, he bailed on a lawsuit against the Akron Beacon Journal, after his lawyers figured out that they would appeal his libel suit against him to the U.S. Supreme Court. He has another lawsuit in Marshall County,WV against the New York Times. Both the Times and HBO hired local counsel from Wheeling,WV, who is best known as one of the attorneys that won a major lawsuit against the NFL, which was the basis for the film, “Concussion.” Locally, the attorney is known as “The Big Kahuna,” as he has never lost a case in court.
