It really doesn’t matter what the jury awards, unless the defendant settled for that amount, it will be appealed, and the amounts cut tremendously. I recently served on a NYC civil case, and the judge indicated that the number of million dollar plus payouts in that year that were actually paid out in New York state was only a handful. And he also mentioned the people that received them, were so badly injured, that you would never want to be in their shoes.

For her sake I hope whatever she does get is used for her law degree and helping her help others like her because that is horrifying

“Experts believe that high levels of lead in children can cause developmental delays, and the damage from lead poisoning cannot be reversed.”

If you do not believe that historical poisoning of black families in all of these major, urban areas contributes to lower graduation rates, under-employment and lack of impulse control in many black children who go on to lead criminal lives as adults, you simply are not dealing in reality. White folks all over the political spectrum are quick to point to fatherless households and black on black crime as the reason behind the lack of upward mobility in black communities — conveniently forgetting the rampant AND historical environmental, housing and employment discrimination that created these communities filled with under-achieving young children and young adults through no fault of their own. It sickens me! We need more headlines like this!

As a former NYCHA employee, I’ll say this:

She’s not getting that full $57 mil. No way. The city is petty and when it comes to NYCHA, they fight tooth & nail to keep every single cent. This also sends a confusing message because there are quite a number of lawsuits against NYCHA for various repairs that were never done, and for an awarded amount to be this high, it will conflict with the other lawsuits, especially when it comes to their payouts.

NYCHA is infamous for holding a $1 billion from HUD that was supposed to go to repairs across the board that NEVER HAPPENED. And the truth is, they never will finish those repairs because up to 80% of NYCHA’s buildings need to be condemned. I know it is impossible to kick out all Housing tenants so that they could have better built homes, but the truth is that’s going to happen at some point because these old buildings just can’t accommodate them. Just like the MTA subway problem, you cannot just keep fixing old infrastructure with patch jobs. They need to be redone from the inside out.

I hope this lawsuit sets precedent for what NYCHA needs to do from here on out. I hope this victory helps this woman properly take care of her daughter and the other children. But mostly I just hope folks in Housing get a better chance at living in proper conditions.

Hopefully, she will be able to collect within ten years, because those bastards are going to appeal as hard as they can.

Seriously, lead in your system affects your mental capacity, with that much in your system is what is told in the story.

She could have had a good life but is deeply affected for her life now. Jesus, a life destroyed because of simple things to get rid of...

I’m sure the folks in Manhattan won’t mind a special real estate tax assessment to pay for this oversight. Just like they don’t mind paying for decades of police brutality, sub-par schools, and an overtaxed transit system.

So the authority was failing to conduct legally-mandated tests and harm was caused? I hope somebody’s going to jail for that.

(Yeah, I know the likelihood of that happening. A girl can dream).
