    There are no perfect victims. That is so right.

    Before even reading that he was high, I didn’t care. Frankly, I thought he was that forceful and strong with the officers because... I don’t know... he was trying to fight for his fucking life. Black people know this will probably be our last seconds on earth. I’m sure I’d summon the power of 1,000 men if I could.

      Why shouldn’t he have been scared? He was profiled and shot for doing nothing wrong!!! Why should he think he is any safer with four officers? Why should he believe they are trying to get him medical care?

      Not surprising if you’ve ever read arrest reports for a while. Police can make just about anything they want into a basis for resisting arrest - two that always stuck with me in a short period of time was one guy getting written up for putting his hands out (because he was “bracing” his wrists/arms) while another got called out for keeping them at his side/not being compliant enough. Add the bs of “not responding to commands” which ignores all the data on how messed up everyone’s perception of time and events gets in these stressful, adrenaline laced moments and you’ll almost always have some element of noncompliance you can point to as objectively justifying the charge (and if you have iffy probable cause on the initial charge it becomes a really handy fallback for both police and prosecutors looking to avoid a massive civil liability or even criminal charges of their own- such as in this case).

    Heinous through and through, but the thing that keeps getting me about these cases - and there are too, too many of these cases that fit the same damn profile - is this gun ho cop blowing somebody away in a traffic stop. When did cops in America start channeling Judge Dredd to the point that misdemeanor moving violations (at worst) are offenses worthy of summary curbside execution?

    Uncomfortable, awkward or contentious as it might have been, this entire incident should have ended with Jones showing his license and registration and the officer leaving with a “good day to you sir, sorry about the trouble.” What’s infuriating as hell about this (well, one aspect) is that all the same tired defenses will come up about the cop feeling justified in shooting him (spoiler alert: “I feared for my life.”) yet what will probably stick is the due process violations suffered afterward in the hospital. Can’t go after the cop for trying to execute the guy on the street, but can go after the department for violating his rights after he survived. What. The. Hell.

    THANKS BE TO THE FOUNDERS for giving us the civil apparatus, because lord knows the criminal one is rigged in favor of these bigot coward murderers - Jones won’t get justice, but at least he stands a halfway decent chance of getting a settlement to cover his hospital bills and lost work outta this b.s.

      By the by, this is also exactly why the cop in this type of situation needs to be immediately charged and booked and interrogated by an investigator: getting sent home for a few days/weeks (months?) of paid administrative leave is a whole lotta time to concoct some story about how it all went down. (There’s a reason the cops start asking questions before you’re even mirandized.) But now that they know he was high at the time, they can talk about how Jones acted erratic and unpredictably and continued to try and attack the officers even after being shot twice and cuffed and pinned to the ground. Statements captured that evening, before the hospital questioning, before any blood tests, would tell a different version of the story and give the jury a little insight into the cops’ motivations.

    The doubting and rationalization that occurs with black victims rarely occurs with white ones. Heck, they use it to an advantage and you know there is a storied history of white men and women claiming imaginary black assailants to cover their crimes...

      Oah yes, I still remember Susan Smith claim of being carjacked by a black man, kidnapping her two sons when she actually murdered her own babies.

      I always think, do they hate us that much? Why not say it was white kidnapper?

      If she had said white kidnappers, most people would have said “Really? Some random white people you YOU NOT KNOW came and attacked you for no reason?” It would have raised suspicion — maybe she’s involved with criminals, maybe it was retaliation, maybe one of them is the father. But if you say that one or more black man randomly attacked you for no reason and kidnapped your children — everyone is just going to believe you. Because ... racism. When she thought to herself “What story can I make up that people are likely to believe” that’s the story that came to mind. White people do not have to actively hate black people to use racism for their (our) benefit. That basically happens automatically and you can then decide to help it along or try to get it its way but the underlying presumption that you are telling the truth and that you are good person is there regardless.

    The Mesquite Police Department claims that Jones “demonstrated such physical strength that it took three officers just to hold him down until paramedics could arrive at the scene to assess his injuries.”

    Golly. Who could have guessed that Negroes would exhibit such godlike strength after getting shot? Time and again, we hear about the imposing size of black men (Tamir Rice, Michael Brown), or about how we’re just so goddamn savage (Jones, Rodney King). It’s Same Shit, Different Day 101: Dehumanize us and then you justify almost anything.

    The police department’s story sounds false like all the stories we hear when they need to cover their asses. The victim being high had no bearing on him being abused. We all know this cop is not going to be found guilty of any crime though (same as all the rest). Hopefully, the victim can at least win the civil suit so he can at least take care of his medical costs.

    So the dude is minding his own business, gets shot by the police, they jump on him, and then they think that he must be a violent criminal because he could summon strength to fight off the people he thought were trying to kill him. Obviously, this guy needs the book thrown at him. Maybe next time that’ll teach him to be less black.
