Here’s the thing. They are going to have to go through some serious contortions to navigate this situation. If the police officer faces charges (IF) and gets off (probably), as has been the case with black police shooting victims, the narrative will focus on bad policing and bad police practices (standard operating procedure). White people are not going to like this one and the public will put a lot of pressure on police reform. They have the “perfect victim”.

However if the police officer faces charges (IF) but does not escape charges (HAH!), then the narrative becomes about the difference between white and black police shooting victims. The police union and state attorney general have to protect this “bad apple” just like all the rest in order to maintain the fiction of equal justice under the law. That will also have white people in an uproar. There will then be a lot of pressure on police reform because of the “perfect victim”. None of these “reforms” will include actual reforms to the over-policing and abuse of black communities.

See, you see the big picture here. As fucked up as it is, there are benefits to Bennett saying this shit: 1) hes a lawyer and is going to do/say whatever to win. He could have intenionally said this shit knowing how it will be perceived. Use the racism against the racists. 2) if he wins, it will undoubtedly be obvious how the systemic racism is so pervalent in similar cases with a black victim. There will be no denying this shit. Of course, like you said, any reforms would not really address the racial issues, but at least it will be more obvious.

Idk, its late and that might not make a lick of sense.

Lawyers call this “bad facts.” You’re so right. And I am sad that most white folks don’t have the analysis to remotely parse through the nuances of this situation as you did above, making it a really shitty situation for any growth/change.

It’s because they finally found their perfect victim. She was white and blonde and rescued ducks out of the sewer.

Except you could’ve stopped at “white and blonde.” The whole reason they went with a sob story instead of digging up dirt from her past is because she’s white. FFS, an old Asian man fought for his seat on an airplane to be there for his patients and the first reaction from the media (albeit, just one source) was to dig up (inaccurate) dirt that justified him getting dragged off the plane bloodied and concussed.

Nothing makes Black victims imperfect except for being Black.

Where’s the marijuana investigation? Because I’ve been told just one instance in your system can turn a person into raging cop killer. Why aren’t we waiting for the cop’s story before we know what really happened? Did they not find a cell phone in her hand? Is that just as dangerous as a wallet in a black hand?

And yet the guy who’s so fed up that he has to blow up a federal building in OKC, killing over 200 people was....white. *That’s* the part I don’t understand, ie - why black people haven’t revolted. White people revolted against England and created this country over a lot less than what black people have suffered.

Shows you the utterly individualistic nature of the just-us system. To be a “zealous advocate”, this attorney decides to distinguish his client by using code words (as Tomi correctly articulates below) and cultural stereotypes to bolster her family’s case.

As such, he throws any momentum and solidarity for systemic change in police behavior under the bus. This statement just conforms to the cognitive lens of policing that already views any deviance, and certainly deviance from whiteness, as a precursor to criminality. Not helpful for social change, but great for damages and % based contingency fees in this one case.

    Just-us indeed.

Yeah this is definitely the hyperbole that is meant to benefit this client right now. He did it with the Castile case and he’ll do it with the next one. “This is the most extreme case I have ever seen” is what they have to say every time. Even if it is complete bullshit, that’s how they have to play or they won’t get these cases. If you have an issue with grasping why and how they do their job then that is one thing. But being able to admit that it is just hype means that so can many others, and the negatives that people also want to apply can’t stick. Either we all get what he is doing or we hear code words, but it is intellectually dishonest to take both sides.

He is a lawyer. And he’s right. She’s a do-gooder, in the most extreme sense of the word. Her life is devoted to her spiritual path of do-gooding. He would be a terrible lawyer if he didn’t play off that.

Rosa Parks was not the first black woman arrested for refusing to give up her seat. However, the ACLU passed on other black people who were charged and went to court with Parks as the main figure because they wanted a solid case to strike down the practice one and for all, and the woman arrested before was pregnant out of wedlock. They wanted someone to make headlines who couldn’t be smeared so easily, in order to get the change they wanted.

Using someone “more sympathetic” for a cause is not new. Not great, but not new. If she is the wake up call to conservatives that MAYBE cops ARE going too far, then blare it everywhere, because the hundreds of other cases and dozens caught on video haven’t worked so far.

Hey, maybe even Ben Carson could agree that this woman was murdered and it wasnt her own fault this time. Wouldn’t that be something.

The difference you are ignoring is that Rosa Parks was picked over another Black woman. This time they are lionizing a white woman whilst ignoring the innocence of Black people to do so. I mean really a 12-year-old boy wasn’t fucking innocent for these motherfuckers to give a damn? So basically, a Black person regardless of age will never be innocent in the eyes of these people and you want us to just pretend there’s no problematic implications to this statement?

      No.

EDIT meant to reply to SulymanF.

You are a fool if you think that any traction created for this white woman would be applied to a black victim in the future.

Have you ever heard the term: DOUBLE STANDARD?

You need to look it up, and commit that to memory because what you wrote is absolutely insulting to black people in America.

Let me quote this form the article you commented on but obviously didn’t comprehend:

Damond’s shooting was unfortunate and tragic, and her family deserves justice, but let’s be clear, the biggest difference between her and other innocent victims of police shootings is that she is a white woman.

Aiyana Stanley-Jones was 7 years old when Detroit police officer Joseph Weekley “accidentally” shot her as she lay sleeping in her grandmother’s home. She was in her pajamas. Was she not innocent?

“I’m not saying Philando wasn’t innocent too, or that Frank Baker wasn’t innocent,” Bennett said. “But here is someone who called the police and was trying t0 stop someone from being hurt … and ends up being shot in her pajamas.”

    Nah...Robert Bennett

You hit the nail on the head. It’s almost like you could rate his performance in real time.

“It’s quite clearly an improper use of deadly force on someone who it is impossible for me to conceive of as a threat to anyone,” Bennett said Thursday. “I mean she saves ducklings out of the sewer, for God’s sakes.”

Irrelevant but good to paint your client in as high a position as you can to get public perception on your side. 7/10

Bennett has worked on other high-profile cases over police conduct, including working with the family of Philando Castile in a settlement over his shooting death in Falcon Heights and representing Frank Baker, who was bitten by a police dog and kicked by a St. Paul police officer last year.

Okay... this is his moment. He could tie black and white together. A unifying “We need to be on alert together—people of all walks of life need to acknowledge that this is a serious problem that affects all of us. 9/10

Calling Damond “the most innocent victim” of a police shooting he has ever seen, he quickly added,

3/10 ... what are you doing? There is some mental gymnastics he’s going to have to use to get out of this. I’ll attempt something (probably equally as poorly): “I don’t want to get into the differences as I’ve had both the opportunity and solemn duty to represent some seriously aggrieved parties. However, what I can say is that the only reasons my client is dead is that she called for help from her very murderer. We should really take a pause when anyone has the very police they call to protect take their life. Again, this should be a wake up call for all of us to unite against a ridiculous abuse of police power and call for more stringent standards in police hiring and training. I’m sorry that I’m rambling; all the cases I’ve taken have started to add up. Obviously I should think through a prepared statement.” I’ll rate myself here 4/10.

“I’m not saying Philando wasn’t innocent, too, or that Frank Baker wasn’t innocent. But here is someone who called the police and was trying to stop someone from being hurt … and ends up being shot in her pajamas.”

Dude.... you are a lawyer... Everything you say is always going to be twisted. WTF!

2/10... I get what he is saying based on the facts (and “zealous advocacy”) but to everyone reading this, he just said “white chick” = innocent and “black men” = not as innocent.
