    I think the icing on the cake is Rudy Giuliani’s original comments and Stephen Miller’s comment on NBC(?) that this ban would be “substantially the same policy” as the first one were both used as evidence for the complainant.

    This is a good time to remind everyone that the administration has yet to present evidence supporting the need for the travel ban/Muslim ban.

    They have plenty of time to fear monger in official statements though. The evidence thing is just as lacking now as it was after the surprise first ban. The record has not significantly changed.

      Someone on NPR (I think with the ACLU) was basically saying the evidence thing is the kicker. If he had any sort of evidence these countries were more of a threat than other countries, we would probably not be able to fight anything. But since he put it forth he planned on banning Muslims, and then did this “travel” ban with no evidence of the reasoning for it, it doesn’t hold water.

      I’m not going to breathe easy until I know it’s gone forever, but I think that will only happen when there is no longer a Republican in the White House. I think he will keep trying this over and over.

      Yeah, if they had an even half-competent justification the courts would probably give them wide latitude to potentially target Muslims because of vague appeals to national security.

      But so far the best they’ve done was, well, not good.

    Best part is that Hawai’i beat out a ruling in Maryland which means this goes back to the Ninth Circuit Court of Appeals that wasn’t exactly all super happy with Cheetolini’s first effort.

      This. It’s not like Dolt45 cares about other folks feelings or judicial utility at all - but federal judges do not care for it when attorneys bring something back that they screwed up the first time, and they made no significant improvements to it prior to the court’s review a second time. That’s a waste of the court’s time, something you always want to avoid (if you’re a sane person and not a maddened bigot).

    It’s worth taking a moment just to savor the fact that these dildos honestly believed there was a combination of magic words that would pass constitutional muster when printed on paper. They honestly believed that the reason why they couldn’t float a Muslim ban past federal courts was because of the way the first attempt was phrased.

      What really made me howl was that they hung themselves. Rudy the first time, bragging on Faux Noise like he thought he was gangsta, and Steve “The Nazi” Miller the second time shooting himself right in the foot with “The intent is the same”, to placate their crazed base of bigoted morons, and not even knowing that was what he had done.

      And worst yet? Nobody even from the White House Counsel’s office even trying to stop him, let alone from DOJ.

    I don’t want to sound cynical but these court judgements do little to persuade Muslims that America is welcome to their visits, residence or business. Ever since 9/11, the US government has maintained watch-lists that often contain names of Muslims, by and large, and target particular countries. During the Bush era, it was like 21 Muslim-majority countries plus N. Korea (as if anyone can get on a plane in Pyongyang and fly to LAX or wherever).

    My childhood dream was always to live in Sugar Hill in Harlem (I wanted to be near where Ella Fitzgerald lived) and when I finally accrued the funds to cross the border, I got on a Greyhound bus from Toronto to Niagara Falls. At the border, I was asked to get off the bus, kept in a room for hours and had to walk back (since the bus has left) to Niagara Falls. When Obama took office, I decided to give it another go and decided to try the border at Windsor, ON. Same thing again.

    What is being done now to combat this systemic issue is almost too little, too late. It’s like closing the stable doors after the horses have already gotten out.
