    Sounds like yet another violation of the Establishment Clause, unless Abbott is willing to stipulate that the cremation (not burial) is required for reasons of public health rather than religion or ritual. But that would defeat the purpose of pandering to Christian fundies.

    While it’s hashed out in the courts, the abortion clinics who have to follow the rule should conduct the interment of the remains under Muslim burial rituals, with a big public “Allahu Akbar” acknowledgement to Abbott at every ceremony.

      Apparently the original version of the bill required the fetuses to be crucified and then resurrected, so this is actually about as secular as it gets in Texas.

      But truly, I don’t see an Establishment Clause problem here. The state is allowed in a number of areas to legislate morality, even without a public health purpose, and even when that morality is imbued with Judeo-Christian values. If they are not actually mandating a particular religious treatment of the fetal tissue, the courts will probably let it slide on a First Amendment challenge. Undue burden under Planned Parenthood v. Casey is a more likely avenue of attack, assuming the cost to abortion providers significantly impairs affordable access to abortions.

    Here’s the reason, right here.

    It’s not about respecting human remains, it’s about adding another unnecessary cost to abortion to either drive up the cost of abortion (making it more difficult for people, especially poor people, to obtain one) or else make clinics go under when they can’t afford yet another new cost tacked on and don’t want to pass it on to the consumer.

      Actually cremation of the remains is probably being done already. Aborted Fetuses would be categorized as bio-medical waste and if not used for research or teaching purposes would most likely be incinerated in a medical grade incinerator. As not alol fetal matter is used in research or teaching this must already be happening.

    Aside from the effect this might have on abortion access, I can’t even begin to think on the effect this would have on science and research that is dependent on these types of tissues, not to mention possible medical products that may be made from these tissues.

This is just another tactic to make it not monetarily viable to get an abortion since burial and cremation can both be extremely expensive.     Did Republicans forget that they voted for fetal tissue research in 1993 because it is ridiculous to waste valuable tissue?

    In 10 years, the argument against abortion is going to be “that tissue could be used to save lives but the evil clinics just throw it in the ground or set it on fire!”
