      I don’t think he should be arrested and he can say what he wants or burn a flag. Now if you’re going to tell me all speech is consequence free then the sky is a different color in your world. I believe in our republic but I also happen to be well acquainted with the human race. This guy ain’t above getting his ass kicked for asshole behavior than anyone else.

    The Attorney General of Illinois does know that the Supreme Court declared flag desecration laws unconstitutional years ago right?

      If you can’t respect the law as a state AG you need to resign. This is a case where the case law is clear and wishing it were otherwise because you or others are butt hurt about it is at best disingenuous.

    This is known as a heckler’s veto. Police (or legislators, when drafting laws) use the potential negative reactions of another party to justify the curtailment of an individual’s right to free speech. This leads to a self-fulfilling prophesy: if a party knows that they can shut down speech by offering negative reactions, they will offer negative reactions. This is poor public policy. Usually authorities are only permitted to curtail speech in the case of negative reactions if there is an immediate threat of violence.

      For those wondering, it’s not uncommon for laws to remain on the books (though unenforceable) long after being declared unconstitutional. Sometimes out of laziness. Often out of protest.

        The law was enacted (2013) over two decades after SCOTUS ruled it unconstitutional to makes such laws (1989).

        Then how was IL able to pass the law in 2013? Why are legislatures allowed to pass laws that they know to be unconstitutional?

        Notes: I’m assuming lawmakers know the laws they’re voting for are in fact unconstitutional, and I’m too lazy to read or do the google for answers to my questions.
