Having covered courts in a small town for a newspaper once, I lived in fear of a particular judge like this one. You may not think the story was worth pursuing, but this kind of behavior should outrage everyone and lead to an investigation of the judge and potential removal from the bench. This is outrageous.

A court reporter wouldn’t usually transcribe what a bailiff is saying, unless that bailiff is responding to the judge, on the record. So it’s not surprising that the extra n-bombs aren’t in the transcript. Also, the audio recording is likely the property of the court reporter, something she created to help her prepare her transcript. It wouldn’t be subject to FOIA. Sounds like the journalist sued a private citizen in order to subpoena her personal notes.

That being said, court reporters are secretly some of the craziest people you’ll find in a courthouse. And they often have a much closer relationship with their judges than they should. This one likely played a significant role in how this situation escalated.

i know in my jurisdiction and others surrounding me, yes, the reporter’s audio would be her property, but, if sh has the county defend her because she is a de facto county employee, I would guess the recording COULD be subject to a discovery order.

seriously the journalists buddy fresh out of law school should not have done the pleadings, though.

also, the court reporter’s wills and trusts attorney should not have filed the counter claim either “you want to prove its false? give me the recording” Seems counter productive

How is it her personal property if she was hired by the court? It’s the court’s property because the court has jurisdiction on what she can or can’t do with it.

That’s like saying your work product for your employer doesn’t belong to the company. It does belong to the company because they pay you for it.

—“I don’t react well when my honesty is questioned,” Weaver said.

She said others in the community were using Thomason to get at her. “It’s clear this is a personal vendetta against me,” she said. “I don’t know how else to explain that.”—

Good god. She comes right out and says she had him arrested for entirely personal reasons. The fact that she’s comfortable enough to basically say, “Yes, I do use my position as a judge to extract revenge on my enemies — wanna make something of it?” is even more disturbing than the minority report shit with the check request.

In other news, someone on the grays is quite seriously arguing that this proves the need for the second amendment. Apparently the only way to deal with government overreach is to start shooting officials. Pity Thomason didn’t think of that — his life would be so much better right now!

She sounds paranoid as well, though I suppose that based on her behavior there well could be secret cabals hoping to have her fired/disbarred/impeached.

From what I can tell about the story there is a male defendant in the original case, a male reporter, his male lawyer, a male judge, a male prosecutor, and a female court stenographer (who YES, brought a ridiculous legal suit up). But the photo header is of the only woman involved in the case, and now many of comments focus on her looks instead of the multiple cases and issues at hand.

Andy, I have really come to love your writing and reporting, and I don’t know if you were the one that made this decision, but it seems to derail the main point of this issue at best.

Maybe a picture of the JUDGE would have been a better choice and kept the comments focused on the actual story? I’m not saying she’s not a bribed, piece of shit, but come on now!
