      Or because Judges know not to allow emotion into the equation. The State failed to prove it’s case. They never had, and never will have, any evidence showing a “rough ride.” This has been a witch hunt from day one. I’m proud to have such a jurist representing my city.

      But wasn’t the whole issue with the “depraved heart” charge that it needed to be proved that this specific act (as compared to just being able to point to other cases where the BPD has given a “rough ride”) was an intentional act of omission and the person knew full well that a likely outcome was death?

      From Gawker’s last article on this, a University of Baltimore law professor:

      Officer Goodson is charged with depraved-heart murder in a case that on its face seems more like negligence, whereas depraved-heart murder says that the individuals showed such wanton and reckless disregard for human life that it amounts to malice. That is a very different mens rea that the commonwealth says is akin to intentional murder. The example I use in class for depraved-heart murder is that the students stand on the roof of the law school and throw cinderblocks off the edge into a crowd below. Where they’re not aiming for anyone specifically, they don’t have the intent to kill, but they’re perfectly fine with the possibility that they might crush someone’s skull. That’s depraved-heart murder. It’s a pretty significant step from that to failing to buckle someone into a van.

      Not necessarily. They’re still are going to have to go through the internal police department discipline hearings, etc. Also, from a PR point of view — and for their own safety — I don’t see how the department allows them to work out in the community ever again.

      Keeping their job is separate from criminal conviction. The police could determine they committed fire-able offenses with far less evidence than “beyond reasonable doubt.” Depending on the union contract, they could even just be fired if the brass lost faith in their ability to do their jobs.

      So, short answer: yes, they’re untouchable. Blue wall of silence, bitch.

      Does anybody know whether there was an option to find him guilty for some kind of negligent homicide/manslaughter offense? Or is the law in Maryland that if you’re being tried for murder, you can’t be found innocent of murder but guilty of a lesser count?

      It seems like a pretty difficult case to make if there’s no fallback option.

        Just listened to this coverage on NPR, and I truly think the prosecution dropped the ball on who (or what circumstances) was responsible for the death of a young man. They couldn’t provide evidence of a rough ride and actually completely dropped that theory in the closing arguments.

        Moseby will most likely be voted out next term, her husband didn’t get anywhere with his mayoral run.

          There’s no way a DA’s office will ever go hard on a group of police, ever. It just doesn’t happen. Nobody was going to be held accountable for this guy’s fate.

        Baltimore Circuit Judge Barry Williams also found Goodson not guilty

        This verdict might really piss off the community, this guy might want to change his name for his own protection. I would suggest Johnny Bravo.
