It looks like the misdemeanor charge was for the sale/purchase of organs, which I guess one could say he technically never did. The felony charge is going to be easier to prove as long as they just have the forged documents.

It would be fucking cosmic karma to see this asshole lose some of his rights with a felony conviction considering his entire goal in life is to limit the rights of women.

ETA: Read the ruling. It looks as though Texas law permits medical offices to donate tissue/organs in return for a fee. Which is what Daleiden was doing and why the charge is being dismissed.

This is hilarious because it FUCKING PROVES that Daleiden’s video is horseshit and that PP was acting completely lawfully in their talks to get reimbursement for fetal tissue/organs. Of course, I doubt anyone is going to report on it like that...

  That’s not why it was dismissed. It’s not that the exceptions actually apply to him (they don’t). The problem is that the prosecutor didn’t accurately state/explain the law to the grand jury, so the resulting indictment is invalid.

  Actually, it was for “offering to purchase,” which is also illegal under the Texas law. That is, what’s banned is buying, selling, offering to buy, or offering to sell human organs.

  I don’t think he’s closeted - he’s attacking the rights of pregnant women, and lesbians rarely have unintended pregnancies. My guess is that he had a crush on some girl until he heard she had an abortion and that destroyed his idea of her; so it’s his mission to stop all other future potential Mrs. Daleidens from accessing that type of medical care.

Worth noting that this dismissal was apparently based on a procedural error. So literally nothing Daleiden just said about it is true. Someone in the prosecutor’s office just screwed up drafting the indictment.

  It was both procedural and also a statement on Daleiden’s crackpot theory. Prosecutors failed to negate the exception to the law. The exception to the law is the reimbursement of tissue/organ donations to a medical facility for valid purposes, which is was Daleiden was doing in the first place. The judge just basically said he wasn’t doing anything illegal, but it certainly isn’t going to be reported as such.

  The exception doesn’t apply to him. He wasn’t offering reimbursement, he was offering to buy. He would have been guilty of this misdemeanor if it had been properly pleaded. Even though the exception doesn’t apply to him, the prosecutor was supposed to let the grand jury consider it. The fact that the jury didn’t get to consider it makes the indictment defective.

  It was just a procedural issue related to the way the DA’s office worded the indictment.
  
  “The judge ruled that the court does not have jurisdiction over the case. The judge ruled that the indictment was based on Texas Penal Code section 48.02 but the indictment did not reference the exception named within the Penal Code section. The judge ruled that “The indictment’s failure to negate this exception renders it void.”
  
  He’s still on the hook for the felony tampering.
