    Persky made a controversial evidentiary ruling which allowed the jury to view seven photographs of the alleged victim “partying about a year or so after the alleged gang rape. In the photos, she is scantily clad, wearing a garter belt and what appear to be fishnet stockings.”

    That is some bullshit right there. I’m having a rage stroke. Screw this judge.

    Though the De Anza case didn’t go “viral,” it speaks, perhaps, to the contradictions of a judge who campaigned as tough on sexual predators and a vocal advocate of victims.

    This is probably the most galling part of an extremely galling story. This asshole used scarce public sympathy for sexual assault victims in order to get elected and then turns around and then helps ruin actual victims’ lives. Fuck you Aaron Persky.

    What is it called.. that a judge this reviled, the world over, with multiple petitions that include over 500k at last count.. and who has jurors now refusing to be in his courtroom.. and yet he refuses to resign, collect his life-long retirement and just get the fuck out??!       He is under JRS II. He won’t be eligible to retire under JRS II. If he had been appointed/elected to bench before 1994-95, he would be in the original JRS, and barely able to retire with his age and length of services.

      His problem was that he rubber stamped the pre-sentencing report from the county Probation Department. A better pressure point would be the voters force Santa Clara County Board of Supervisors to clean house at probation department.

      He’s hoping it will blow over.

      And there’s a good chance that it will.

      You can bet there are a lot of locals who aren’t plugged-in enough or who aren’t certain the sentencing was so egregious as to demand firing him.

      Hell, you know some people will buy the “alcohol made him incapable of recognizing his inability to recognize a lack of consent” excuse. Or assign a measure of blame to the victim. Or even not believe her.

      I think that people are generally intimidated when in a courthouse in front of a judge. Also, really think that saying that to a judge would constitute the crime of contempt of court. Potential jurors can be held in CoC for not showing up for pretrial selection, so telling a judge to go fuck himself would certainly apply.

In the photos, she is scantily clad, wearing a garter belt and what appear to be fishnet stockings.” Lawyers for the defendant claimed that the photographs were a “direct contradiction” of the alleged victim’s claims. The victim, inevitably, lost the lawsuit.

    It seems like this judge has some firm opinions about how women should behave. FUCK THIS GUY.

      Except that it was the plaintiff who was making claims about her behavior (or alleged inability to engage in certain types of behavior) - not the judge.
