    I’ve never understand how “severe impact” is calculated or applied. Isn’t 6 years in prison a “severe impact” on... anyone? It’s not like this guy is supporting anyone financially or has kids.

    I also recall some rich guy in Colorado, after [If I recall correctly, popped for his nth DUI] had his conviction set aside entirely because, the judge said, “he’d get fired from his high paying job”. Like, damn, if I’m 30 minutes late to my shift at McDonalds because I got pulled over for expired tags I’ll get fired too, you know?

    Also, jesus, I’m sure he could have readily convinced a blackout drunk girl to have sex with him; why go for passed out ones?

      The thing is, they didn’t even HAVE to listen to women. There were two men that saved her, chased him off, and acted as eyewitnesses to his crime, but his welfare is still prioritized before hers. And arguably, before the welfare of his next potential victim.

      “A prison sentence would have a severe impact on him…I think he will not be a danger to others,”

      He honestly just means other men. No men have to fear this guy. Women don’t count. We’re worthless to men like this.

    He’s guilty. That’s for sure. Here’s my big question for general discussion: What should he have gotten?

    Follow-ups: Does anybody have a reference for sentencing guidelines for the crimes he was found guilty of? If so, how are those guidelines arrived at? Did Persky follow those guidelines?

    Perhaps you have to be lawyer to wade through this stuff, but it matters, right? It gets at the point of sentencing. I know we’ve moved away from incarceration as a means of separating the unfit from society. Is sentencing supposed to deter others? Punish and/or rehabilitate offenders? Compensate victims? How is this determined?

    • I want to know what a truly just sentence would look like and how it would address punishment and rehabilitation, deterrence, and victim compensation.
    • I want to know if the sentencing guidelines are fair.
    • I want to know how sentencing guidelines are formed - who is responsible, and are they doing their job correctly?
    • I want to know if the judge appropriately applied sentencing guidelines, or if he deviated from them and how.

    I think there will be a lot of outrage- I just want it to make a difference for others and not just these two people. (Edit: meaning a perpetrator that’s gotten off very lightly, at 1/28th of the sentence, and a victim that, so far, gets nothing- I hope there’s a civil suit in the works.) How do we change the laws that matter? We want to be a just society, what does that look like, and how do we get there?

      Um... I mean... that’s just not about the judge. That was a jury trial, and the jury found the defendants not liable. I thought that judges had to abide by the jury’s decisions, right?

    3 fucking months for raping someone because I guess you get points for not raping anyone (or getting caught raping anyone) in the past! I mean one measly rape isn’t that bad you guys.

    Also, it would be super hard to be in prison and it might make him sad sometimes. :(

      I bet the judge still sees it as bad decisions/boys will be boys. A youthful mistake rather than a predator whose behavior will only be emboldened by this.

    Ok with some sexual assault charges the circumstances even from the victims perspective are so ambiguous that actually sentencing someone to incarceration is understandably difficult. But him actually sexually assaulting, that he didn’t finish doesn’t diminish the act, an unconscious vic and there were two neutral third party witnesses... Damnit he should have gotten atleast 6 years in.

      Well they came upon him mid-act, they might not have been able to rebut how he claimed this thing started. But the other circumstances... behind a dumpster... this is not where hookups happen. The location alone screams sexual assault.

    I almost quite literally gave her a standing ovation at my desk. What a strong, powerful, deeply personal statement. I simply cannot understand how a living, breathing human being can stand there listening to, “ I had to force myself to relearn my real name, my identity. To relearn that this is not all that I am.” and then come back with 6 months. I cannot list the large number of terrible things I hope happen to such a callous “judge.”

    So even when you have two eye witnesses, that are male (because obviously all women will lie for another woman and there for are not to be trusted as witnesses *sarcasm*) and caught the guy in the act, they still won’t believe you. That’s nice. That’s really nice.

    I guess we should all wear body cams at all times, and have little video tape drones, and little chastity belts that have to be voice and eye scan activated, so we can have the proper fucking documentation when we go to court.

    If he’d been murdering her, and been caught in the act, would he then have been found guilty? What does it take?

      He was found guilty. Of all 3 counts. By all 12 jurors.

      The judge doesnt think its a big enough deal and the likelihood of him doing it again is too low to punish him further.
