    Fucking Obama. Employers aren’t going to pay anyone overtime. Think of all the people that will now have their hours cut from 60-80 a week to 40 a week. What are they going to do?? Hang out with their families or something?

    I just wish my co-workers didn’t have a “but we don’t want to go out of business” attitude towards this. If you business model doesn’t allow you to pay your employees fairly, then you should go out of fucking business.

    This is fascinating. I work for a social services non-profit. A college degree is required for employment and we all work 50-60 hours a week. None of us make the threshhold. I’m sure the people in HR are freaking out, but I’m worried their solution to not breaking the law will be to reduce our pay, benefits, even number of staff, etc.

    Good reporting on this Hamilton. I would also add that most employers are already carefully tracking hours for their various required ACA filings, so there shouldn’t be any additional burden there.

    This whole story feels very under-the-radar, when it’s actually a pretty huge shift in payment. HamNo might be underestimating the ability of businesses to cut wages to save on OT, but the net effect is still potentially huge. Can’t believe this made it through TBH

      The rule has no more or less “teeth” than the prior $23k overtime exemption standard. Its teeth are DOL enforcement and employee FLSA suits.

    When did capitalism turn into a zero sum game? Even Henry Ford recognized the need for a strong middle class. If you look at wages of the top 1% since 1979, they are the only sector to really benefit from the steady increase in worker productivity. While the bottom 90% have increased 15% and are basically flatlined. I guess 1979 would be around the time St. Ronnie came into the picture, but even he, by today’s conservative standards, would be considered a moderate Democrat. It will never be enough until they have it all. Almost understandable as power corrupts. What is hard to get is the people in the bottom 90 who hold onto this pipe dream that they may one day look down from the top. Gotta go! There is a post on Facebook, and I won’t believe what happens next!

      Absolutely. Most companies will comply without quibbling—I have personally been involved in the last month with a company re-bidding a large service contract, and they were making good faith efforts to determine which positions will no longer be exempt, and how that will affect overtime, total compensation, etc. For most of the employees involved, it will mean a fairly significant pay increase.

    Give us a few years. We’re working on getting rid of truck drivers and commercial and freight pilots first. And fast food cashiers. And software developers. And scientists. And so on, and so on.

    Pretty soon we’re going to have to answer the question “what do we do with all those expensive surplus people?”.

      Ugh. My husband is a manager and works 60+ hour work weeks. He is literally about $100 above the threshold. Which is fine, and a good living salary! But for the hours he works and responsibilities he has, ends up being pretty low on an hourly basis.

    Many salaried people don’t qualify for the new overtime rate either. It really applies mostly to service and hospitality jobs that are salaried and don’t include tips, and salaried retail and customer service jobs. Exempted: professionals, administrative employees, executives, those with “specialized knowledge” and sales.

      salaried workers making less than the new threshold (except for doctors, lawyers, and teachers) must be paid overtime. Very few unsalaried positions have an overtime exemption. Without looking at the regs the 7(a) retail sales exemption, the outside sales exemption, and the interstate truck driver exemption don’t require the employee be paid on “a salary basis”.
