    Wow—that’s huge. Saudi money is going to flood out of the U.S. so fast it’s going to make our heads spin. Obama is right, this is going to end up an empty symbolic gesture that will only really hurt us in the long run and I guarantee you there is no way they’re going to be able to attach a judgment to Saudi assets because they will get rid of them before they get the chance.

    When I worked on one of these cases as a federal judicial intern in law school I learned that the problem is even if you win, you can’t compel a sovereign state to adhere to the order—that judgment is useless if you can’t execute it. So the method is to execute against foreign assets held in the US. The case I helped draft an opinion on had to do with executing a judgment against Iran, almost impossible because there are no Iranian assets in the US, so the link to the foreign assets gets more and more tenuous. Essentially, the Plaintiffs were trying to seize money frozen under EU law owed to the National Iranian Oil Company by a subsidiary of Royal Dutch Shell, which then brings into play rules of international comity, because of the treaties we have concerning frozen foreign assets. Complete cluster fuck.

      The center where? The center of the Upper West Side of New York? These comments really sadden me deeply. Perhaps most of the authors are too young to remember September 11. Irrespective of that, the thought that so many people would take the side of Saudi Arabia over the US is outrageous. We will get another war soon. It will have domestic consequences and you won’t have time to sit in a Starbucks and type out blogs to nobody. You will get conservative real quick when it happens. When its your survival or someone else’s.

    This is pretty much a toothless law vis-a-vis 9/11, since the official investigation already concluded that the Saudi government was not responsible. There’s still hope that we can, and will, hold Canada accountable for giving us Ted Cruz, Justin Bieber, and Nickelback.

      Do you know who is going to determine liability and the other facts in this case?

      Jurors.

      I mean collecting it is another thing, and it will take a while for Saudi Arabia to pull all their assets, but the complaint that is filed will also include an injunction which will be heard very quickly.
