I think that I asked this previously, but any idea how they divvy up the money? is it a set sum per worker or is there some other metric?

that’s a good question, especially since records are probably non existent/fudged

i also hope this starts a larger probe into other industries, like restaurants, retail, etc etc

Welp, usually when the DOL find labor violations like this, the money is not some lump sum from somewhere. It comes from the businesses themselves. The DOL spends weeks or months pouring over the payrolls of these places (using what ever information the shops use/whatever their payroll system in/their books) to find what they were paid, any benefits, taxes withheld and all that. Then they figure out what they should have been paid. That 2mil figure is what all the shops’ violations totaled. When your business is found to have committed DOL violation, you basically have to run a payroll and pay the employee(s) the difference in what they made and what they should have made. You have to run an out of sequence payroll and pay everyone who was a victim of the violation, while withholding all the applicable taxes you are supposed to by law.

$2 million? That’s it? That’ll cover the nail salons within a four-block radius of my apartment, but that’s about it.

Gov. Cuomo could pay his management-confidential employees, who did not receive raises that unionized state employees did in 2009-10, the money they’ve lagged behind. Talk about a hypocrite -

If they shut down and move to New Jersey, then open up under a different name, do they avoid the fine?

Is the nail salon pictured one of the ones in question? If not, I don’t think it’s a good idea to use their photo. It’s right in my neighborhood and I would hate to see their reputation suffer for misbehavior they may not have been involved in.

This sounds like a redo of a bad sexual encounter with a beautiful person.

Someone should tack on a fine for that awning. If you’re going to scrape the barrel bottom for a cursive font, join the gotdang letters!
