She can’t record music outside of her contract without paying a fee. This write-up is a little confusing.

She can’t get out of her contract with Kemosabe, but she doesn’t have to let Dr. Luke be the producer of her music. She *can* work with other producers, but any music she records will be released under Kemosabe (and Dr. Luke will profit from that)...until a ruling is made otherwise. That’s how I understand it.

What’s not clear is if she’s recording with other producers and hoping that she gets a final ruling in her favor and can take what’s she’s recording now with her OR if she’s just saying ‘fuck it’ and recording, knowing that Dr. Luke will profit from her work.

So is she pursuing criminal charges against Dr Luke or what is going on with that?

She’s not pursuing criminal charges against him and he’s not pursuing criminal charges against her despite claiming she’s attempting to extort and blackmail him.

The events she alleges took place in 2005 and 2008, so they’re beyond statutes of limitations now.

I am happy for her as a person, but her music is horrible. Adding Zedd to the mix shrinks even further my hope for any musical improvement or growth from Kesha.

Kesha already showed a lot of growth with her Warrior album, Deconstructed EP, and that Spookey Ruben song Lover. From the BBC review of Warrior:

“it’s perhaps surprising that she’s showing signs of artistic growth. Like her debut, Warrior is a collection of shamelessly commercial electro-pop, but on several songs, Ke$ha works in her love of 1970s rock....Love Into the Light is a smoky 1980s-style slowie with drum sounds perfect for the Cadbury’s gorilla. Only Wanna Dance With You sounds like Ke$ha covering a Strokes single, and even features two members of the New York indie band – for a supposedly low-rent pop singer, Ke$ha has a lot of trendy mates. Meanwhile, Wonderland is a country-tinged ballad which proves she can sing without Auto-Tune.”

That’s not the point. I don’t care for her music either, but I’m still 100% rooting for her. She’s been chewed and spit out by the misogyny of the recording industry and is proving that it’s possible to make a comeback.

She has good Metacritic scores so perhaps shitty to you but good to critics. Having said that her singles are her worst songs. She’s never been allowed to release her stronger material. Back in 2011 everyone wanted this song The Harold Song to become a single because it’s so damn good but Luke refused to release it.

Since Zedd released “True Colors” on his last album, I’m assuming Kesha will be credited as a featured artist, which is a different situation than if she released her own music.

This industry is a mess, so who knows what the fee and royalty structure will be.

Yeah I was wondering about this too, because she is allowed to perform old songs or covers, so maybe this counts as a cover?

        Ugh what a mess.

She can perform any new material she wants, technically. But in order to do that, she’d have to register it and she’s contractually obligated for it to actually be owned by Luke’s publishing company. So, this is Zedd’s song, she’s just performing it/guesting on it.

For instance, she performed a “new” song on her last tour that Luke wouldn’t let her put on her last album, Machine Gun Love, but since he owned it already there was no harm in performing it. (This was like, 3 years ago though)

Why does my brain hurt so much, trying to understand this situation. So she can record with another producer? The judge ruled she can’t record with another producer? Am I failing reading comprehension??

She’s stuck on the label, she is allowed to release music under Luke’s label without Luke having any creative control. Luke implicitly gets paid when she releases songs under his label, but Zedd ft. Kesha (covering Zedd) may or may not fall under “Kesha is allowed to perform covers freely.”

That last part has no answer, since we don’t know what she’s recording with Zedd.

She’s always been able to work with other producers. But everything has to be approved by Luke because she’s on his label. The offer Sony made to her wasn’t a genuine offer but it was enough to convince the judge. Essentially Sony was offering to put Kesha right back into the same situation she’s trying to leave.

So what exactly is her situation now? She’s free to record without Dr Luke in the room, but he still gets a cut?

Yes (as far as I understand it). She is still on his Kemosabe label but can work with other producers, he will get a cut of any profits from new music. She’s still fighting to be released from Kemosabe/Dr. Luke altogether, but I’m not sure how working with Zedd plays out.

She can’t release anything without Luke’s permission, something he won’t give her. She can apparently release music if she’s not credited and not earning royalties. That’s what she may do with Zedd. Release a song without her name attached and not get paid but at least maintain her career. The Flaming Lips released this song a few years back without getting permission by not crediting Kesha as the singer.
