    As usual Gawker over simplifies everything. Never gives you the entire store. This was a crime infested park. The month prior 3 dozen gang members were apprehended. Many around his age. It was the second most dangerous rec in the city. They just arrested a 13 yo this weekend for committing armed robbery of pizza drivers. So know what you are talking about before spouting off. Samaria dealt drugs. Left her kids for days. Father was absent.

    Am I wrong in viewing this as actually being bad news? I worry that if cities keep getting to settle these suits and throw taxpayer money at people to make these stories go away they will never have to face up to the prospect of actually making the serious reforms needed to stop the next incident from happening. Look at how much money NYC and Chicago keep showering on victims’ families year after year. They’d rather pay than think seriously about changing their behavior.

    I hope one of these suits doesn’t settle at some point so they can win a massive judgment against these cities that really scares the bejesus out of them and forces real changes. I don’t blame any individual family for settling and taking the money, but hope that one such family at some point will refuse to settle and take this trial and beat the crap out of one of these cities.

      My guess is that a lot of these settlements (because these incidents, typically, afflict the very poor) come about by the cities simply dragging their procedural heels and forcing the families to take the settlement money, rather than spend the next 10-15 years in the appeals process. The cities have many more resources at their disposal than a poor family—even one who is getting pro bono representation. At some point, even their lawyer is going to look at their own personal cost-benefit analysis and recommend that their clients take the money.

      I live in an open carry state. Please, do tell us what it means.

      Because I’ve had people right outside my house with actual guns, not practicing proper gun safety, and the police have told me there is literally nothing they can or will do. Unless those people are actively brandishing a gun at me while verbally threatening me AND THE POLICE OBSERVE THEM DOING IT, they will not even be arrested, much less shot.

      So this is how some police departments handle things in an open carry state. But please, tell us more.

    This seems like a pittance to me. I still can’t get over the fact that Loehmann’s employment history isn’t costing Cleveland a great deal more. Cleveland handed a firearm to someone whose personnel file was rife with evidence that he should never be in a position of authority, let alone be given a fucking weapon. Let’s all take a moment to remember that the Cleveland Police willingly hired someone with all of the following in his personnel file:

    “He could not follow simple directions, could not communicate clear thoughts nor recollections, and his handgun performance was dismal,” according to the letter written by Deputy Chief Jim Polak of the Independence police.

    “I do not believe time, nor training, will be able to change or correct the deficiencies,” Polak said.

    The problems at Independence erupted on Nov. 28, 2012, the records say. Loehmann showed up “sleepy and upset” for a 6 a.m. state gun qualification session.

    Police Sgt. Greg Tinnierello wrote that Loehmann “was distracted and was not following simple instructions” at the shooting range.

    At one point, he went to the back of the range to reload his magazine and could not return to the line where he was supposed to shoot from, Tinnierello wrote. Loehmann appeared to be crying and was emotionally upset so Tinnierello said they would stop the exercise for the day.

    Polak concluded his report by saying that Loehmann lacked the maturity to understand the severity of his breakdown on the shooting range.

    So the options for Cleveland are:

    confront racist, sexist, homophobic, etc., institutional culture and suffer fewer lawsuits,

    soldier on in ignorance until city is bankrupt, or

    soldier on and hope for more Panama Paper-like events to hurry regulations that re-direct wealth from the rich to cities, states and nations (taxpayers) so they can afford to maintain exclusionary public policies for its citizens?

    This is really the only way victims of police violence can get any kind of justice. It’s sad. It’s also bad for local governments. The dollar amount of police brutality settlements paid out by the City of Chicago over the past decade is staggering. If that money had not been paid out, Chicago’s finances, while still bad, would be noticeably less bad now.
