    #notallrapes

Because, sure: every lynching of a black person isn’t motivated by racism.

And every gas chamber that made it from blue print to reality got there thanks to architects, not the desire to kill Jews.

Some rapes, commited by men against women, are apolitical people.

WHY DON’T YOU STUPID BITCHES GET THIS??? PATRIARCHY ISN’T PERSONAL!!!!

I get your point, but would it really help the situation if all rapes were also prosecuted as hate crimes? For one thing, they require separate trials.

To the extent it prevents against this kind of juridical obtuseness, I say, yes, it would be helpful.

      I suppose same-gender rapes usually aren’t gender-motivated hate crimes.

Apparently the judge said Kesha acted unreasonably when she rejected the offer to retract the rape allegation and apologize.

No, the judge said she acted unreasonably when she rejected Sony’s offer to work with other producers (which was Sony’s original offer some time ago).

I understand her reasons for rejecting the offer to work with other producers if he would still be profiting. But the judge didn’t suggest she should have apologized or taken back her accusations.

It’s just.... rape? A man murdering a woman isn’t a murder related hate crime, it’s just fucking murder. And it’s atrocious and horrible and should be prosecuted to the highest degree. I have no idea where hate crimes came into the picture, but it’s a strange direction to go in my opinion. <— me, having no legal background whatsoever.

I think my problem is with the judge’s phrasing. Not every rape is a gender motivated hate crime? Okay. What’s the distinction? (I am also not a brilliant legal mind, if there really is a distinction I don't know it.)

Um, actually I’d argue most male on female rape* is by definition a “hate crime” that is gender based, because its a FUCKING HATEFUL THING TO DO TO A WOMAN, and demonstrates utter disregard - if not sheer contempt - for women.

*Don’t get me wrong: male-male rape also hateful. Female on male rape = also hateful. I’m of the belief that most rapists are sociopaths. But it is established that the majority of rape is perpetrated by men, against women, so to say that gender is irrelevant here is...bizarre.

Don’t most psychologists consider rapists to be motivated by a desire for power/control/domination moreso than hate or violence or “animus”?

So on the plus side he acknowledges the rape. On the other hand, every single thing about this situation sucks.

Dr. Luke has not been convicted of any crime—-thus far. The judge’s language does not “acknowledge” any rape because a court of law has not determined that a rape has occurred.

according to the full article, the Judge thinks Kesha refusing the deal which would make her take back her accusations was “unreasonable”

The “sanctity of contracts” philosophy is all fine and good until you realize that the only two ways it works out in real life are:

    1. All parties involved are fair and deal fairly with one another at all times

    OR

    2. The party with lesser power/money/influence/whatever-the-thing-is-in-that-situation gets fucked over by the party with more power/money/influence/whatever.

If you are using “sanctity of contracts” to uphold a contract, just know that 95 times out of 100, you’re looking at Scenario 2. And I’m pretty sure President Bartlett would agree with me about how fucking shitty that is.

The term of art for that is “unconscionable” when there is that disparity of bargaining power.

What do you mean by “using sanctity of contracts to uphold a contract”? I thought “sanctity of contract” encompassed the entire concept of enforcing previously made agreements (https://www.law.cornell.edu/wex/sanctity_o...).

Without that what does “upholding a contract” even mean?

If I smack the judge round the head, it will be a hate crime against fucking stupidity.
