This should be dismissed for the simple fact that anyone should be honored if Paul Giamatti portrays them on screen. Even God should be honored that Paul Giammatti played him on Inside Amy Schumer.

That’s certainly an argument that could be made.

Right? He should be paying Paul Giamatti for making him look cooler.

“Allow me to prove that I was not a shady manager taking advantage of your financial naïveté by taking advantage of your financial success through misusing the legal system against you! Ah-HA! Didn’t see that one coming, didja, kids?!””

I know you are just making a joke but it doesn’t really make sense. If this guy feels that he has been defamed, he is taking advantage of the relief the legal system offers him. I don’t see how filing a lawsuit in and of itself is “misusing the legal system.” Also, suggesting that any of the defendants have any naivete whatsoever now (when they are no longer 19 and it’s no longer 1988) about financial or legal matters is kind of silly. Even if he was a shitty manager, depicting specific bad acts that they can’t prove he committed is still ample grounds for a lawsuit.

I practice in LA and it’s not uncommon for plaintiffs to get four or five opportunities to amend, even for it to ultimately be dismissed. Defendants are just going to bring another motion to dismiss the amended complaint. It still hasn’t got over that hump. This says nothing about the merits of the case. Just an attorney’s press release.

“The real life Heller claims he wasn’t such a shady manager.”

How would he prove this? Is there some sort of definitive shadiness scale? “Your Honor, this evidence clearly shows that I was only Scott Boras shady, not John Ehrlichman shady."

Jesus Christ tap-dancing on a cracker. Anyone with any prior knowledge of the band, whether they favor Cube’s “die in a fire” POV, the more measured opinions of Dre and Ren, or even Eazy’s estate’s (for obvious reasons) relatively kind position, knows that the movie’s portrayal of Heller was far, far kinder than it should have been. Sure, cheating your clients is SOP for managers in charge of naive moneymakers, but the racial element in play, and Heller’s cynical “milk-the-cow-to-death-NOW” strategy more than balance out any passionate public defense he might have made of his own personal ATM. Sharing the same bank account as the profitable centerpiece of your band is never a good look.
