I just finished reading the judgment and I have to say I completely agree with the judge’s decision. It is not that he felt that the women’s post-assault actions were inconsistent with being assaulted, but rather that they lied repeatedly to the media, the Prosecution and the Court on numerous points and, once confronted with the truth, offered very odd reasons (i.e. not that they were scared to tell the full version of what happened, but that they considered it irrelevant, didn’t know they were supposed to provide such information, or didn’t have an opportunity before the trial to tell the full version. None of these reasons are believable). The emails between the two witnesses are also really problematic.

Inconsistencies in statements aren’t uncommon, especially when it’s about something that happened 10 years ago and about behaviours that the women may be ashamed of or simply forgot. The judge could have chosen to believe these women and considered that the inconsistencies were not enough to place doubt on the overall issue at hand which was that Ghomeshi sexually assaulted these 3 women. The inconsistencies found do not necessarily have to decide the case - this was a choice made by the judge.

I think that’s what we can all take out of this by way of a ray of sunshine. Ghomeshi is toxic at this point. He will never work in his industry again and his name is forever tied with his disgusting behavior. So while he’s cleared of the charges- we can at least know that he is basically done in terms of his career-

Yep. But one that doesn’t need to get sent to jail so he becomes an even bigger creep with less respect for humanity.

There were holes in the stories and concepts from the start. While I have no doubt he isn’t the kind of guy I’d ever want to come across I do not at all believe any of this can be proved to be criminal.

And that is okay. I don’t like putting people in jail and think we should all do that a lot less. The man had his career killed, which for a wealthy individual is equivalent to jail time. Nothing creates self-reflection and yes, potentially, repentance-with-understanding than having you privileged life yanked away.

As somebody completely unversed in Canadian criminal law and procedure and who followed absolutely no details during the trial at all, I think the judge got it totally wrong*.

    * or possibly totally right, or maybe somewhere in between.

Hehe. I followed the case, and while I’m no expert in Canadian Law, I think they got it right and I called the case a shit show from the start. That doesn’t mean I don’t think he’s a creep and abusive, but the handling of this trial shouldn’t surprise anybody who had been paying attention to it.

In the initial reporting about this case there was the suggestion that Ghomeshi had recorded the encounters using a nanny cam in a stuffed bear he called “Big Ears Teddy.” Did the prosecution try to acquire any of this alleged footage?

It was the creepiest detail of the story. He claimed Big Ears Teddy helped him overcome his anxiety disorder and would make his dates/victims greet him like a roommate.

Not surprising, but so so disappointing. The women get nailed on details like not remembering what his car looked like ten years ago and how they had their hair styled at the time and trying to downplay the trauma, and that adds up to them not being trustworthy on their allegations. Such bullshit. The assault victims are never perfect enough.

I agree with you in general, but there were details that were left out (lied about, etc) that were kinda crucial and did the women no favours. I think if you read the full verdict (and not edited out of context tweets), it paints a much more nuanced picture.

Can we pile on him? Hey Jian, your radio show was the biggest piece of shit I’ve ever heard. I listened once, for about 5 five minutes, and quickly became so embarrassed I had to change the station. I never told anyone I listened because it was such a stupid piece of shit. You are the kind of person who does everything for the wrong reason. Reads books, listens to music, engages in conversation...everything. A sociopath. You’re an idiot who beats up women. Good luck with the rest of miserable life. Hope you get YOUR ass kicked.

Horkins applied a strict reading of the law in deciding Ghomeshi’s fate, stating that his conclusion that there was reasonable doubt of Ghomeshi’s innocence was not a determination that the attacks never took place

Yeah the whole reasonable doubt and innocent until proven guilty things are such annoying technicalities
