    I expect this entire article to be deleted within the hour, once Gawker’s lawyers get a call through to Mr. Denton.

    Anyway, I have severe disagreements about how you run the Gawker media websites — the software is horrible and the ads are getting more and more oppressive (seriously, a 5 minute autoplay video that can’t be scrolled past? Way to make me install an adblocker.) — but in the end I think your heart is in the right place. And the outcome of this court case is a tragedy. So I wish y’all luck with your appeal, and I hope this place sticks around long enough to see Kinja finally become stable and useful.

      Nope. You’re wrong he’s wrong. You know that Florida is a consent to record state right? You can’t use video in court that you didn’t get permission to film. Basics legal principles are being overlooked. Sure, NY might let this shit slide, but we’re talking Florida. Sanford is in Florida. Do you think you’re going to get a NY outcome in Florida?

    The Hogan sex tape was a pointless, hardly newsworthy post. At the same time, Hogan’s stature as a public figure who’d previously discussed the sex tape at length with the media – and is now going on The View tomorrow to discuss it again – undermines the notion that his privacy was invaded. Going on national TV to discuss his privacy is a weird way to rehab an invasion of privacy.

    This whole things stinks. On one hand, it was clearly a desperate money grab by Hogan. On the other, Gawker’s history of forcefully (and rightfully) condemning revenge porn reeks of a double standard here. While we don’t know who leaked the tape to Gawker, their intent was clearly to harm his image. Gawker was the willing middle man in posting revenge porn.

    Still, that *wrongful death* trials often result in damages of less than a million, this insane Florida jury – and the numerous missteps by the judge overseeing the case in omitting pertinent information – makes me optimistic Gawker will win on appeal.

    Gawker deserves to (and I generally like the work you all do), but like the outing of Conde Nast’s gay CFO, one can’t help but wonder why the company is so often staked on superficial, questionable pieces.

    More Rob Ford/Manti Te’o exposés, less takedowns of people no one cares about.

    The decision by a Florida jury to grant $140 million in damages for a story on Gawker.com about a Hulk Hogan sex tape was extraordinary. The number is far larger than even the plaintiff himself had asked for in relief.

    Anyone with a shred of understanding knows that at worst this number will be cut down on appeal if not essentially cut out all together.

      Agreed. The awarded sum is ludicrous, even if I was rooting for him to win, solely out of principle.

      What about Gawker’s (and Denton’s) patent hypocrisy, by the way? Not just in this particular case (Hogan Vs Jennifer Lawrence) but many others, like the issue of unpaid interns?

      I fuckin’ hate hypocrits, and I can’t help but rejoice when they inevitably get their comeuppance.

    Hogan did not sue us, as he has claimed, to recover damages from the emotional distress he purportedly experienced upon our revelation in 2012 of a sexual encounter with his best friend’s wife, Heather Cole (then Heather Clem). It turns out this case was never about the sex on the tape Gawker received, but about racist language on another, unpublished tape that threatened Hogan’s reputation and career.

    What.

    That’s a claim so patently ludicrous that I hope no one genuinely believes it.

    C’mon. You already HAVE a defense strategy. Perhaps your lawyers avoided this one in court because it is so dumb on the face of it?

    It’s like saying that terrorists attacked Belgium because they were worried that someone in another country entirely might hurt their cause sometime.
