    The constitutional right of the accused to confront the accuser. It’s something that does more good than harm, but it leaves victims of sexual abuse and stalking in horrible positions that often results in them refusing to testify. I’m not sure of the solution though. Ideas? Also while keeping in mind to change this would require a constitutional amendment.

      It was Scalia’s majority opinion that brought the Confrontation Clause back. Rehnquist concurred, but would have decided the case on Roberts “indicia of reliability” grounds.

      And/or she told herself that. Which is exactly that which I would have done. Told myself that if I didn’t engage, his tiresome game would eventually lose steam; told myself that if I blocked him, he might escalate; told myself that this was his escape valve, and that to close it might lead to increasingly dangerous confrontations. Told myself that if I requested that he stop, he might become violent.

      And all the rest of those morbid calculations women are forced to make on a daily basis (writ large).

      That’s the thing on Twitter, many times Twitter harassers’ goal is for you to give that contact and acknowledgement through a block. And that block can trigger them to spew more abuse. So the expert thing to so is not to answer, block, or anything, except mute, report, and document the harassing tweets. That’s not bad advice, that’s the proper advice.

      That’s really what it seems like. I never got to press charges against those who hurt me because it wasn’t taken seriously. Had I been able to and the person acted as their own attorney, I likely would have dropped them or not testified because I wouldn’t have been able to deal with facing them like that in court. Through a proxy like an attorney would be hard enough, but having them give your shit like that and question you in court after violating you, whether by stalking, sexual assault or domestic violence, it’s just unconscionable to me.

      The legal system is set up in such a way that they are obliged to be complicit in this continuing crime.

      In order for you to have any hope of justice, you have to participate in the crime being committed against you.

      This is happening because every criminal defendant has a right to confront their accuser (ie cross-examine) and a right to represent themselves. Two very important rights that, unfortunately, are creating a bad situation here.

      Seriously ! I was thinking the same thing. You’d think the fact that he has been convicted a few (I think) times would be enough to get her out of having to answer his vengeful, pathetic, and stupid-ass questions face to face. Can't they do a remote questioning like they do for children? Where the victim is in another room and answers questions on a monitor.
