It makes me hopeful that Justice Kennedy will rule HB2 unconstitutional. Honestly though waiting to find out is going to make me insane. Every time I think about it I feel nauseous. I am hopeful that we are moving in the right direction but the fact that HB2 even exists is troublesome.

if i understand, though, this doesn’t signal any kind of a landmark shift in the court’s opinions about abortion; they’re just telling the circuit court to cool its jets on the louisiana law until they rule on the substantially-similar texas law. so it’s more about not wanting the circuit court to go making decisions on this type of law until after scotus has ruled.

Yeah. The story really could have been clearer. In particular “the court struck down such a law”’is factually incorrect.

Yeah, phrasing like this is kind of crappy— if for no reason other than it makes it sound like better news than it is and the article isn’t much clearer. Still good news! Especially for women in Louisiana who might need an abortion before next year.

(But if I had to provide another reason, it’s because most people don’t know how the appellate courts/SC work as it is.)

    From the original article:

The high court’s order, with only Justice Clarence Thomas noting his dissent, came two days after the justices heard arguments in a major abortion case from Texas and just hours after they voted in a private meeting on the outcome of that case. (emphasis added)

    THIS IS POTENTIALLY FABULOUS NEWS!!!!!!!!

Oh, and the single dissenting vote? Who could it possibly beeeee…?

(for those who can’t already intuit the obvious answer resonating in the very core of their being, it was – of course – Clarence Thomas. What a putz.)

The Supreme Court put death penalty cases out of Oklahoma on hold before eventually voting to uphold the laws. We shouldn’t get too excited.

Thank. God. This, combined with Justice Kennedy’s comment in re the Texas Women’s Health case as reported in NYT has me a little hopeful:

“My reading indicated that medical abortions are up nationwide, but down significantly in Texas,” Kennedy said in a displeased tone, according to the New York Times. “This may not be medically wise.”

Kennedy’s qualm isn’t obvious, but it appears to signal that Kennedy is concerned that Texas’s law is limiting women’s access to abortions early in their pregnancies.
