    Trump’s defamation claim was frivolous and would have certainly been dismissed. His breach of contract claim, on the other hand, had merit. While Univision’s lawyers came up with the best argument they could (that Trump’s conduct had frustrated the purpose of the contract), it was a reach. At the very least the case would have survived a motion to dismiss and summary judgment, and it was in neither side’s interest to take on the risk (and in Trump’s case, embarrassment) of a jury trial, much less the significant attorneys’ fees it would take to get to that point.

      Oh, the number was certainly bullshit. Claims re the amount of damages in a complaint always are. But he definitely had a chance of prevailing on his breach of contract claim, and if he were to win his damages would have been substantial—not $500 million, but substantial.

    He probably took peanuts (comparatively speaking) since his case was so frivolous, even putting aside their knowledge of him being a horse’s ass. The case was rather early in the game, too. If a small business owner, for example, has a fed-ex man who makes bigoted remarks whenever he or she drops off packages at, say, a shoe repair shop, the shop owner can call fed-ex and request, and receive, a new delivery guy immediately. What’s the difference here?

      The small business owner typically doesn’t have a written contract with the fed-ex man. And Univision didn’t simply request a new fed-ex man — they dropped the pageant entirely.

      Trump’s defamation claim (alleging that Univision’s CEO defamed him by comparing him to Dylan Roof) was frivolous. His breach of contract claim was not.

      Trump won in the sense that Univision had to give him some money, but Univision won in the sense that they no longer have to be associated with Trump. But a settlement means nobody really won in the sense of a court deciding one party was right and the other was wrong.

    I’ll bet the settlement was like $10, so that Trump could save face and Univision could save money on legal fees. Univision should have let this go to trial so that Trump could lose and get embarrassed right in the middle of his campaign.

      I work for Univision in LA and I heard around the office that Trump settled quickly after they offered him not one, but two luxurious, scalped manes taken from their telenovela stars.
