    Proving that Daniels’ comment was made with ‘actual malice’ is essentially impossible, and Penn has a snowball’s chance in hell of winning. So it makes you wonder what his motivation was for even bringing the lawsuit in the first place. I wonder if it was to finally pressure Madonna to come to his defense, which she did for the first time ever only after the suit was filed. Maybe they worked something out together?

      Maybe, but the Streisand Effect applies to both Penn and Howard here. As a woman, I get a bad taste in my mouth on both accounts, and contemporary denials mean jack shit to me, as we know how lies and power go.

      I did not know what the Streisand Effect was until it was referenced here (recently, I think). So in part The Streisand Effect has the effect of calling your attention to the Streisand Effect, in turn calling your attention to those photos. This must be Babs worst nightmare...

    Such a waste of time and money. How is he going to prove Daniels knew that his statements were false? It’s clear, even from his statement that he doesn’t know shit, but was throwing out names based on old rumor and press statements.

    Why isn’t Penn going after the tabloids that printed this info or the blogs that reference it? They’ve done it for years, but now Daniels’ statement is the problem?

    Penn is better off spending his money on a safe room or some shit for when El Chapo escapes again or sends one of his sons after him.

      Disagree.

      Win or lose, Madonna’s on the record. No one can use the allegation about him being an abuser who tied her up, etc., in the Press anymore without taking a chance of slandering him.

      People, even rich ones, tend to like to avoid lawsuits and courts and the time and money it takes up, even if they might win, if the easier thing to do is simply not say something they can’t prove.

      Did she deny it prior to the lawsuit? If not, then that can’t be used against Daniels, who can still say his info was based on rumor and what had been printed in the press for years.

      Yea, its seems as though he is saying, “Marlon and Penn had great careers after (allegedly) beating women, Howard should be able to too!” When it should be like, “Hey, why don’t we make sure that all future (alleged) abusers are held to the higher standard that Howard is held to (11 movies and two TV series in the last three years).

    That’s going to be an almost impossible hurdle.

    By the way, I’ve seen the kind of folksy, sarcastic writing in legal filings and always found it offputting. I assume judges do, too.

      I have to think that the only real place that stuff belongs in is an anti-SLAPP, where you’re basically accusing the other side of deliberately trying to take away your rights through the legal system. Some level of snark is allowed for that, I’d say, since you’re essentially telling the court “Legally, you’ve got to be fucking kidding me.”

      Even then I think it’s counterproductive. If you want to poke fun at outrageous behavior, the most effective rhetorical device in my opinion is the occasional subtle joke — make the reader proud that he/she caught it.

      Ummmm this sucks. Ignoring anybody who abuses anyone sucks. Terrence Howard sucks. Sean Penn sucks. The long list of men in Hollywood who abuse women and children and get in “bogus” fights and basically throw around their power and really need to take an anger management class SUCKS.

      And yes, black men who are taking the brunt of the backlash for being abusers over white men sucks too.
