    If a drunk adult has sex with sober minors, who is raping who?

    One might say, well, she can’t ‘consent’ if she was too drunk, but you also can’t consent if you’re 15.

    Was she raped by some and did she rape others?

    It sounds like I’m making light, but it actually does sound like a complicated mess from a legal perspective.

    I have a hunch that the video is not the “compelling” evidence of his client’s innocence that that lawyer thinks it is, unless he also has as fucked-up a notion of consent as the 14-year-old probably-rapist.

    If this story is going where it looks like it’s going, it could be that the boys were the victims of statutory rape by the father and perhaps the daughter, depending on the age of consent laws in New York.

    Whatever it is, it sounds pretty depraved, but probably not that uncommon. An ex-boyfriend of mine told me that he lost his virginity at 12 to a 19-year old young woman who was taking boys one after another, as in, she invited a bunch of kids to her house, had them sit in the living room, then took one after another into her room: “Okay. Your turn.”

    People have issues.

      I at first thought perhaps the dad was prostituting his daughter out. And then I read the article. Who would have thought that my assumption would be almost less fucked up than what actually might have happened? Jesus, the dad and the daughter were having sex?!? At a park? And it was consensual??!?

    So, they want to say she “consented” which also must mean that once you’ve consented, you can not change your mind. You’re in it for the whole 9 yards or whatever.

    She may have a messed up background and there might have been alcohol hindering her and her father’s response to the situation, but that still doesn’t excuse rape and definitely doesn’t excuse (or justify) gang rape.

      I also hope they do a consent determination intellectually, just to be sure she even understands what consent is when she's sober. I would like her to get whatever help she can, and it's nice to have a full evaluation to really look at all aspects of the person.
