    The former Comm Law student in me wants to know why he didn’t sue any of the reporters or biography authors for the initial and ongoing reports. Because it seems Lee Daniels isn’t defaming him, just repeating 25 years’ worth of rumors, innuendos, and possible facts. I’m super curious about the timing of Penn’s lawsuit; why did he choose to jump on Daniels’ comments?

      This is what I want to know. Even if I give him the benefit of the doubt and assume that he didn’t do it, these rumours have been circulating FOR DECADES. Why now? Why bring attention to it? Why didn’t he sue anyone after he made that racist comment at the Oscars and people started talking about it again? I feel like considering that’s high on the list of white men Hollywood has given a pass to, this would have easily blown over in a week if he hadn’t prolonged it by suing.

    I’ve heard the rumors about the domestic abuse since I was a kid. There isn’t any real definitive evidence, and Madonna herself has denied it. Now whether or not it’s true, no one except those two knows. Mr. Penn has done a lot of good things over the years, and unfounded allegations of abuse are just pathetic. Now if she admitted to it, or there were definite charges filed, or it was on film that would be a different story. As is, both parties deny it and that’s ok with me. Mr. Penn does have a history of aggression, but a lot of other actors do as well. If it is true, then he is a fucking asshole. As it stands though, the allegations seem unfounded. Really, until one of them says, yeah it happened, I don’t see why to not give them the benefit of the doubt. I mean, look at all the tabloid headlines out there. If they were true, hollywood sounds like the fucking thunderdome, populated by lizard people always boning each other.

    What could possibly compel the Material Cocksocket to provide a written statement to, essentially, the courts that would let a supposedly abusive ex-husband get away with the kidnapping, forcible confinement, sexual assault and battery of her almost thirty years ago? Why is she helping to protect his image with this statement to start with and, even more-so, why would she do this if there is any chance at all that a police report might be available that contradicts this written statement?

    It makes no sense as she has little to gain and much to lose if her deposition is proven to be false. So why does she even get remotely involved?

      Damnit, this is about semantics and bored locals and publicists.

      There are so many things that could be true about this and yet the main facts as reported be incorrect.

      If The New Yorker reports Penn was not arrested, you can be reasonably certain Penn was not arrested.

      Penn could have had his house surrounded by a SWAT team, had them yell with a bullhorn, and get put into a cop car and not be “arrested”

      He could have gone willingly to the police station for quesitoning, no arrest needed.

      Same goes for all this stuff.

      Penn could have threatened violence, and attempted to grab Madonna and in self-defense Madonna could have bloodied *her own lip* by accident.

      It’s still Penn’s fault, but the lip isn’t bloody b/c of a strike to the face.

      Semantics.

      Madonna could have locked herself in the bathroom during a fight and Penn could have forced her to stay in there for 9 hours, menacing and threatening, until she finally climbed out a small window, falling into a thorn bush.

      Maybe they both were into bondage and wanted one last romp, then their fight got into the bondage sex and Penn crossed the line into abuse.

        There’s also a huge amount of focus on whether or not Madonna or Penn denied that these events occurred, and a lot of parsing of their words to make it seem like they did not. But first of all, a lot of that is a reach - “she can tell them I didn’t” tie her up seems pretty close to a denial to me - and second, what does it matter? Someone who would be capable of tying up and brutally beating their spouse surely wouldn’t be too bothered about lying about it to a reporter. Heck, Cosby’s repeatedly denied all the charges against him and absolutely no one believes him - so why even bother using any of Penn’s statements as proof?

      As far as I can tell Penn must be hurting for money and Daniels never said that Penn had been arrested for domestic violence. I guessing Penn is going to lose this lawsuit.

        He’ll absolutely lose. Even if there is no truth to it, at all, Daniels likely believed it was true when he said it. And for public people you have to show malice or that he knew he was lying and said it anyway.

        It wasn’t malice he was just “defending” Howard. And he likely didn’t know it was a lie, if it was, when he said it. It’s been repeated for decades without Penn really refuting it until now. (Not that that makes it true it just means Daniels couldn’t know for a fact if it wasn’t.)

        One thing that goes unmentioned here is how stringent the UK libel laws are in comparison to those in the US. It’s pretty telling, then, that the first biography of Madonna was published in the UK, and no legal action was taken. (If I remember correctly, many members of the Saudi royal family have effectively squashed a number of books/ publications that suggested they had ties to funding Al Qaeda or other terror organizations.)

      Madonna’s saying that Sean Penn didn’t hot her pretty much is standard fare for abused women. I don’t think either Penn or Madonna sued anyone who said Penn abused Madonna. And most of the excuses seem flimsy at best, especially from Penn

      Why would Madonna lie after all of these years? It’s probably because she still cares for him and or is compelled to continue to lie about it for whatever reason.
