    People on articles this morning kept whining about how this isn’t fair for him because of double jeopardy!

    Then when explained that the laws are different they complained that it's not fair that the government could stalk and harass this poor man until they could get the sentence they wanted.

      It’s not fair to Reeva Steenkamp either that she was shot to death for getting up in the middle of the night to use the bathroom, but I bet they aren’t complaining about that.

    Wow. Apparently they don’t have the same constitutional protections as we have. Not that I’m making any statement on his guilt or innocence. But what a process when an appeals court can find you guilty of a more severe charge.

      Most courts in the world can do this :/

      If the law was misapplied, the law was misapplied. Of course, in my country’s case, the appeals court would likely send it back down to the lower court with a “try again” note.

      Makes me happy to live in the US I guess. I mean, the whole point of a jury trial is that they are the factfinders and your peers. If an appellate court can give you a harsher punishment than a jury, what’s the point of having a jury?

      Exactly! The first sentence was garbled nonsense. I’m not from SA but the criminal principles are similar to those in my jurisdiction. that first sentence was a miscarriage of justice. the fact that he claimed he didnt know who was behind the door did not make it not murder.

      I hope for the sake of the Steenkamp family this is the end of it. Her poor parents don’t need to keep reliving this in court over and over again. Also no more swanky house arrest, if the higher sentence is upheld he has to go to jail this time because house arrest is only applicable to five year (or less) sentences, according to a different news article I read this morning.

        I think he can appeal - but only on the grounds that he wasn’t given a fair trial, which as far as I understand, is not likely.

        Poor Reeva’s parents. I hope this means some closure for them and the knowledge that they won’t have to fear running into him or his smug face at any point in the next 15 years.

        Yeah, in the article linked above there’s a really heartbreaking quote from Reeva’s father about how now that it’s really over they can finally start to move on with their lives.

      People are idiots. Court ruled that trial judge misapplied the law. There is no double jeopardy issue. This was an appealable issue on a point of law and the prosecution won.

        Plus, South Africa is not America and they may have different laws there, right. (Not sure if SA has or doesn’t have double jeopardy, my country doesn’t, for instance).

        Yes! Finally this court understands the issue at play. The question of guilt or degree of accountability should not hinge upon the identity of the victim in this case. What matters is, whoever the individual was, they were effectively no longer a potential threat once the bathroom door was closed, and when Pistorious fired through it, he was no longer acting in self defense because there did not exist a reasonable, immediate existential threat.

        Frankly even if the victim had been an actual robber, I would still support this verdict. Because what Pistorious committed was indeed murder.
