Posted this to a response but I want to make sure everyone can respond. Not trying to argue with anyone. I want an open discussion. You know, like how the government should be doing... anyways here we go!

I’m...ugh...going to be that guy...how do we know that DNA testing is even accurate?

Sure, it’s the best available test but (plug:Adam ruins everything) already proved how finger prints , eye witnesses and the lie detectors were once considered iron clad over only the last 100 years only to now be nothing more than a tool of manipulation, laughed at and not even admissible in court. Which ironically, we’ve used DNA to disprove all the time for death row classes just like this.

GAWD I’m not even feeling good about this but holy shit man! Is there any doubt that 1 or 10 or 100 years from now “science” will find a way to disprove DNA?

Nor you, I, or anyone can prove what happened in this or any situation. It’s the complexity and simplicity that is humanity.

The best thing we can do *for each other* is allow the accused in cases like these the choice between the death of their choice or the right to fight the verdict as long as they’re alive because you never know what will come to light with a few more years, a little more science, a little less corruption.

    Fuck!

    Sincerely,

    That guy

If true, would go to credibility of the witness making the claim. Maybe it wasn’t HIM she was kissing.

I guess I'm confused that he denied it by saying he went and had sex with her in a parking lot and then punched her. Seems a weird thing to quibble over if you're going to admit all that.

The County District Attorney Greg Edwards, however, said there were no doubts about the accuracy of the case.

If there were no doubts why did you block it?

They’d already waited 20+ years, what’s another 90 days unless there were doubts in the evidence you didn’t want to be seen, causing a massive scandal over falsely imprisoning someone for 20 years.

And there it is. I’m all for incarceration and - depending on my mood - execution of murderer rapists. But to deny a test that would either a) lock in the case once and for all, or b) show the guy’s innocent, is jenky at best...

There were several episodes of SVU and The Practice (and I’m sure other law shows) that covered this ad nauseum.

Basically, the argument against testing is that it is a ruse to halt the process, take up more time, waste of resources, and, ultimately, everyone on deathrow would want a dna test. Ain’t nobody got time for that!

On The Practice, a motion was brought to a court, and the judge ruled that if the convict was represented by his lawyer with no issue, and there was no reason to question the prosecutor’s antics in court, and all other evidence points to the convict as guilty, then DNA evidence wouldn’t be relevant anyway.

Still, it’s TV and all, but I can’t see any other reason why they wouldn’t want to.

That’s a bit of a curveball. I actually felt bad for the guy for a couple paragraphs.

Also, you should probably start reading things before you hit publish. This shit is a mess.

DNA testing should be automatically granted in every death penalty case. There’s no excuse to withhold it. If you are going to demand the ultimate penalty, there should be additional precautions taken.

They already did DNA testing on the guy’s clothes, and found they were covered in the victim’s blood. There’s absolutely no doubt about his guilt. He was just asking for DNA tests on other stuff to delay his execution.

They did some DNA testing originally. Johnson had blood on his jacket that matched blood from the victim. Although, DNA testing on the blood from the tree branch did NOT match the victim so ¯\_(ツ)_/¯

The only way this could get more Georgian is if the killer also ball-gagged the victim with a ripe peach.

U.S. Supreme Court rejected his appeal for a stay of execution. No reason was given for their decision.

They should seriously be required to explain themselves, and especially when the stakes are so high.

This is the same DA that pursued a young woman who had had a self-induced abortion with meds from Canada.

Dougherty County District Attorney Greg Edwards says he’s never seen a case like this, but it’ll probably go to the grand jury, because it’s at least worth exploring whether a young woman who was obviously in a desperate enough situation to terminate her pregnancy — that is the reason women buy illegal abortion pills on the internet — is maybe a murderer who should lose the child she has and go to prison. Just askin’.
