    Rape is one of the most awful things one person can do to another. What’s this Judge said is undoubtedly reprehensible. But... There’s law in Canada requiring you to fully ask for consent? Seriously? I mean, that seems insane.

      The law says someone must take reasonable steps to make sure they’ve attained consent. If you have a problem with that, I have to assume we can follow the standard internet comment rule of disregarding everything that comes before the “but...” as disingenuous.

      Reasonable steps doesn’t necessarily mean you have to stop the proceedings and sign an affidavit. For example, and not to be too crude, if a woman is grinding into your lap and making out with you, then reaches down and pulls out your junk and says she wants you, she’s consenting. That’s reasonable. If, on the other hand, you are watching a movie with your date and start kissing her on the neck, and she doesn’t stop you, so you slide your hand into her pants, and she doesn’t stop you, so you take her pants off of her and do your thing, that’s not reasonable. Sitting quietly and not resisting isn’t consent.

    So the former justice minister who appointed him, Peter MacKay, is a noted misogynist and racist. He just chose someone who agreed with his views.

    I mean the bigger story should be that this judge’s verdict has been thoroughly discredited and the provincial court of appeals has ordered a new trial based in his admitted misconduct. But gawker hates Canada this week so let’s go with the fact that there’s someone shitty everywhere if it makes you feel better.

      That’s not a story because that’s what should have happened. The bigger story is that even after that despicable behavior, the Canadian government saw fit to elevate him to the Federal bench.

      I am not trying to pull this one out of the poo. The judge was horrible and deserved his due reckoning but I find it laughable how this judges egregious actions were not written up by gawker when they were relevant, when he made his wreckless verdict, nor when Harper elevated him, but now— even though his verdict and his reputation has been thankfully overturned by the provincial courts— because gawker has decided that anti-Canadian clickbait journalism is really riling up the commentariat this week.

    It’s sad to say, but looks like the Great White North also has its fair share of Great White Assholes. This hasn’t deterred me, but most of the reasons I one day would like to emigrate to our northern brothers is because I’m looking forward to leaving these kind of people behind. I hope my idea of Canada doesn’t end up being just a bad case of naiveté.

      Canada (particularly Calgary) is an MRA hub for some reason. I think we let the presence of socialized medicine trick us into thinking Canada is a lot more progressive than it is. See also the treatment First Nations people get.

      Not Denmark, Italian Circuses. Apparently Italian authorities uncovered a human trafficking ring involving illegal clowns. No kidding. A whole bunch of circus owners took advantage of some circus loophole in their immigration laws and smuggled in thousands of “clowns” for $15,000 a pop. This fucking world.

    For the record, the judge made these comments in September 2014. He was then *promoted* to the Federal Court in June 2015.

      At first I thought he was being a metaphorical dipshit asshole and just insinuating that she stop being a “slut” and deserved what she got for not keeping her legs closed.

      And then I realized he was just an actual, dumbass asshole who literally thought this woman should just have welded her legs together with the force of a thousand Kegel exercises in order to deny consent/prevent a man who very much wanted to assault her from assaulting her.
