    RBG is right (as usual). The problem is Roe. By framing abortion as a 1st Amendment privacy right rather than a 14th Amendment equal protection or due process issue, the stage is set for this sort of whittling-away. If the Court in Roe had ruled on the discrimination issue inherent in abortion access, we’d have a much stronger platform to argue for these rights and conservatives wouldn’t have been able to get such a stranglehold.

      I’m barely joking. The pro-choice movement is in absolute shambles. We’ve become so used to the day in and day out attacks against PP that we just stopped having he energy to fight back. And in the war of attrition, we’re losing and we’re losing badly.

      Women and men are not getting out and making their voices heard in anywhere approaching the level of our opponents. And it’s partly a matter of privilege. Wealthy women who need abortions are mostly unaffected by this, because they CAN just drive to the nearest clinic, and take a day or two off to do it. And all the women in blue states think of this stuff is just not going to affect them, so they don’t have the same urgency.

      And people suffer. I honestly despair because if the Supreme Court doesn’t step in hard here, well, that’s pretty much it for a national right to abortion.

      I totally would. Fuck the possibility of biological children, it would destroy my life more to have forced unwanted pregnancies right now and for many years from now, than to want to get pregnant and not be able to, later in life. It’s not worth it, y’all.

      I want kids and I still think at what would happen if I get pregnant and end up discovering a terrible problem in the section bs trimester as I know it happens to some women. Very few places perform second trimester abortions even if there is a terrible health problem with the fetus that will make it suffer through the pregnancy and die after birth. It’s scary

    What angers me about TRAP laws is that they specifically target the young, the poor and the vulnerable. Even if Conservatives and religious fanatics managed to ban abortion outright, they would still be able to obtain them for their wives, daughters and girlfriends if necessary. In the bad old days when abortion was illegal the wealthy always found a way.

      Not so much the wives. These men (and women, sadly) believe the role of a wife is to serve her husband and have as many babies as he wants. Hence the extra girlfriends/mistresses. He can’t be expected to abstain just because wifey literally can’t have sex after giving birth.

    Bastards. I can’t imagine what this woman went through. I still remember my one pregnancy scare and the paralyzing fear of how it would derail my life (wasn’t pregnant, turns out can’t get pregnant); do the people behind these efforts have no empathy? Do they even spare a thought for the people they’re deliberately impeding while they’re sitting in back rooms trying to come up with imaginative little roadblocks and administrative hurdles and fucking hoops for the young and the poor and the frightened to jump through?

    They’re not even subtle about it, in Texas or elsewhere. The attorney-general for Texas said in court when the case was before the Fifth Circuit Court that the law was meant to make getting abortions hard enough so that women might choose childbirth instead. In fucking court IIRC! And naturally it still went in their favor (goddamn Edith Jones, supreme Reagan hack).

      There’s SCOTUS precedent that says it’s perfectly fine for the government to encourage/incentivise/prioritize childbirth over abortions. I can’t remember the cite offhand. It might even be Casey.

      It’s certainly cited in R v W: The state has an interest in the production of new citizens, therefore the state may legislate pregnancies that have entered the second trimester (I forget the exact phrasing). Somewhere around 25 weeks or so, you legally become a brood cow. I think the hidden premise is that pregnancy and birth are considered so onerous that one cannot expect a reasonable person to opt in. It sets up a lovely catch-22: if women were rational, they wouldn’t choose to have children unless forced, and if women choose to have children, then they can’t be rational and therefore require government supervision.
