    Ok, first off, this is terribly sad. I hate this.

    But, the suspect “didn’t fire his weapon” means the cop shouldn’t have fired? Am I missing something here? Because to me the cop most definitely should not wait until a suspect fires. If a guy has a gun you don’t wait until he fires first. If you did, uh, you would be shot/injured/possibly dead.

      Except then you’re setting yourself up for failure. You can’t have a state where private citizens are encouraged to arm themselves and stand their ground against a perceived threat, and plainclothes cops are expected to take the first shot against an unknown armed person. It’s a formula for killings just like this.

      Yeah, sure. But that’s an entirely separate point. That’s an argument against current policing strategies, guns, stand your ground etc. But it’s not an argument for “waiting for a suspect to fire first.” No one would seriously argue that — which makes the fact that someone didn’t fire first pointless.

      Argue all the stuff you said — which i agree with — but don’t argue cops should wait until someone fires first.

    So yet another cop with a history of ‘questionable’ behavior is simply given a pass and sent back out on the streets to once again shoot a Black person and then claim they had no choice.

      I disagree. I don’t believe that when, quote;

      His car broke down at night and an unmarked van pulls up with a plain clothes officer. Of course the victim would have his gun on him for self defense and it looks like the officer failed to make the situation clear and decided to fire first.

    I am a completely normal looking white male. I would not wave a gun around near an officer, because he would shoot my ass. The same goes if I was in say, the UK, or Canada. I’ve seen the cops from ‘the great north’ draw down on people. This is ridiculous. With this kind of wordplay/fact manipulation you could write for Fox News.

      Whether or not he was intending to use the weapon isn’t really relevant - the standard for self defense is how a reasonable person in a similar situation would react.

      Ironically, the case often taught in law school is that of an undercover officer getting shot by a person in self defense when the undercover officer was actually approaching said person to render assistance (the person was being mobbed by an angry crowd).

    That’s a pretty important detail...

    Of course you’re gonna crucify this cop and include every detail about his past and not the suspect. “The officer didn’t disclose that he once broke wind in front of his sergeant. All signs are pointing to guilty.”

      That’s in no conceivable way relevant. Whether the decedent was armed with an illegally purchased gun isn’t an element of self-defense. The analysis is the same whether Jones was holding a legally purchased water gun or an illegally purchased AK-47.

    Not a thing will happen to the cop after their “investigation,” and we’ll all be outraged when it happens again in about ten days. Then nothing will happen to the cop after their “investigation.” We live in a localized police state, kids, and, quite frankly, Obama needs to get a tad more expressive about our “cop problem.” How long can we tiptoe around it??

    If you’re a plain clothes cop, in an unmarked van, approaching a vehicle, on the side of the road at 3 AM, it would seem to me that you have the burden to show you’re a cop to the undoubtedly freaked-out motorist. Hang your badge around your neck, call out to him from a distance, call it in to dispatch to see if it’d been reported. Something. This stinks of the cops who show up at burglary calls to the wrong address and shoot the home owner and their dog.
