    Broken bones are fucking expensive, even when you have health insurance, and it was the dad’s insurance really being sued. Not the kid.

    It happened in this guy’s house and because of his kid. Why shouldn't she file an insurance claim?

    I’m sure she’s not the best person but I just don’t have the energy to hate on her for filing a claim against his homeowner’s insurance.

    And “reasonably prudent eight year old” is a legal standard. It isn’t just being a bitch.

    Gawker commenters are really really protective of the feelings of insurance companies is the only take away I get from this.

      Where does it say she’s suing the insurance? I’ve read a lot of articles on this and it all says specifically tha she is suing her nephew and that her nephew shoukd be held responsible. Just wondering if I missed that!

      Holy shit you’ve got to be kidding.

      My husband had a fucking TBI at 21. He didn’t sue the ski lodge for overpacking the limit and exceeding the fire marshall. He nearly died and the guy who ran into HIM tried to sue his parents!

      My husband is STILL suffering complications but he didn’t sue fuck for it. A broken wrist??? Fuck the fuck off.

      Chances are the dad and sis-in-law are in on it, and fucking each other, and trying to get the kid's trust fund money. Also rumor is mom killed herself.

    She may well be an awful person, or this may have been an insurance issue (as in, she may have had to sue bc the homeowners’ insurance didn’t want to pay out—in which case the dad may have even approved of the lawsuit, who knows), we really don’t know. What is clear is that we live in the only country in the first world where breaking your wrist can be a potentially bankrupting experience. That seems like a more serious problem than the potential existence of terrible individuals.

    You know what? I don’t even care if I was wrong earlier about there not being a potentially good reason for the lawsuit. Even if this was a situation about trying to get insurance payments (which, again, we are all presuming, as no article on the issue has actually stated that and all we have is conjecture), I still think the lawsuit was a terrible idea and the lawyer is a bad person for bringing it.

    “We do not take great pleasure in bringing a minor to court,” Connell’s lawyer, William Beckert, said, according to the News, “She is not here enjoying a moment of this.”

    This guy still sucks for taking his lady’s case. The lady lives on the Upper East Side and expressed that holding hor d’oeuvres is now too difficult for her. Quite frankly, the pain she likely put her brother and her nephew through is not fucking worth $127,000.

    /I will revise my opinion if, and only if, any actual evidence that the father and son actively solicited this lawsuit, or that the family was okay with it.

      Stop saying that the homeowner can solicit such a lawsuit for purposes of insurance. It is absolutely a violation of the conditions of the insurance policy to encourage / cooperate with the plaintiff and not mount a full defense. The insurer wasn’t going to — nor should it- lay down on the strength of this woman’s claim. In other words, it was always going to be contentious because it was a bullshit suit and a waste of judicial resources.

    So what’s the real story? The mother died and left the sister out of her will, sister thinks she’s entitled to something, so she sues the kid, thinking the estate, or the remaining parent's homeowner's insurance will pay out?

    I'm pretty sure one of my wife's sisters would try to pull some crap like that in similar circumstances.

      Sister had medical bills from the broken wrist. Wanted Dad’s insurance to cover them. Sued for the damages and tacked on a bunch more in special damages (stupid move IMO) and hoped that they could get a verdict for the insurance co to pay.

      i have one of those sisters... our mother collapsed and died of a brain aneurysm while at a casino with her. sister actually threatened to sue the casino because their efforts at cpr were unsuccessful (duh).. but the casino was able to dodge it when that handy surveillance video showed her coming back to the casino later that night after all that unfortunate drama at the hospital ended.

      and she wonders why she’s no longer invited to holiday gatherings...

      The even better revenge will be her spending every birthday, holiday and special occasion for the rest of her sad, ugly life alone, abandoned by the family she betrayed because she was slightly less fun at parties because she couldn’t lift a platter for a few months. I don’t think the article specifies, but if the surviving parent isn’t her sibling she’d better be prepared for even more isolation - if I lost my wife while already being sued by her sister for six figures over a minor injury, you better believe dear sister-in-law is never coming within sight of me or my kid until my kid is a legal adult and able to decide to forgive and go see her himself.

      She said he was negligent in excitedly jumping into her arms, and a “reasonable eight-year old” would know better.

      See, there’s the problem right there, that’s why she lost the case. Everyone knows there’s no such thing as a reasonable eight-year old.

      I say this from the fond perspective of having raised three sons. Reasonable is not the word I’d ever apply at just about any stage of childhood development.
