    I.... What?

Is this woman represented by a lawyer? I feel like any lawyer should have had the ethical obligation to tell her that this lawsuit has literally zero chance of succeeding.

Either she’s an insane woman suing pro-se, or her fucking lawyer needs to be disbarred. Because I don’t care how much of a scumbag ambulance chaser you are, suing a small child for something like this should be unethical and not only that should be totally awful PR for the lawyer.

No mention that the tort occurred more than 4 years ago and the statute of limitations has long since passed.

Edit: it’s 3 years in New York, so maybe not “long since”; in my state it’s 1.

In reading the article now, it appears to have already gone to trial (there’s mention of testimony), so apparently it was filed in a timely fashion.

      BUT STILL.

I live in Manhattan in a third-floor walkup so it has been very difficult

Maybe you just run up the stairs with your devil-may-care attitude, but some of us have to hold onto the banister.

Relevant point . . . this is probably covered, in its entirety, by his father’s renter’s or homeowner’s insurance and he just has to sit through this before AXATravelersZurich cuts this woman a check and his father’s premium goes up 4%.

I don’t know how long I will live but I hope that 35 or so years from now, I get to read the headline “woman’s remains found in her third floor walk up after she’d been dead for five years”. I cannot think of anyone more deserving of such fate.

My then 11 year old cousin stole a pair of pants from me. I wish I’d known at the time that this sort of legal action was possible.

I kind of want to know more about this. For starters were you eleven too or was your eleven year old cousin adult size or are they just a klepto?

It actually is more malicious than it sounds. I was 16 at the time, visiting the cousin’s family for holidays. I’d only packed 2 pairs of pants. Once she realized this, she decided to steal my other pair so that I’d have to wear just the one dirty pair the whole time I was there.

I think this was precipitated by my last visit, when I busted her for carving her name into the kitchen table (as if that would’ve been a difficult mystery to solve). I went from fellow kid to “management” that day.

Good clickbait, but I’m sure the woman had to file the lawsuit to get the homeowner’s insurance to pay the claim for her injuries. It’s not like she’s seeking a lien on the 12 year old’s future assets or anything. It sucks that the kid’s father’s insurance premiums will go up. Unfortunately that’s how insurance works.

This is most likely what's going on. Still there's this small part of me that thinks she's going after money the kid inherited when his mom died.

Good! Teach the little bastard early in life that family in particular and humanity in general suck. I wish someone had sued me at eight, so I had this information earlier and spared me the grief of learning it. HEY! I should sue my family for pain and suffering!

This is a requirement of most insurance companies- you have to sue to get them to cover what you already paid premiums for.

Yep. My parents had to sue their homeowner’s insurance company in order to get it to pay for damages caused by Hurricane Sandy. They finally got the money to fix their roof last year.
