      Because of demographics (old people dying), the sort of progress that took 50 years prior to today, will only take about 10 starting tomorrow, and this is absolutely the case in Kentucky for a number of reasons. Kentucky has always been a bit embarrassed of the South (It didn’t secede from the Union in the Civil War, it was invaded by the Confederates for example), Obamacare has been a huge success there, and it’s already embracing “green” energy, so the reliance on coal is dying out. They are basically becoming more progressive by choice, and then seeing real, actual benefits of doing so.

    I commented on the story yesterday on Jez, and I’m still curious: what’s the endgame here? Obviously, Davis (and apparently her staff/brother/son?) would rather go to jail than issue these licenses. But what happens if the people of the county just keep electing assholes who promise not to issue marriage licenses? What if that’s the whole election platform?

      It’s weird to me that anyone saying people like this should be removed get a response that “well they’re elected officials.” So? Is there no procedure for removing an elected official who don’t perform their duties? I feel like she has superiors who could remove her from her post for failing to do her literal job.

    Would someone who knows law-stuff fill me in on what consequences the clerks in this office might face?

    Also, for anyone who didn’t click the linked article, the clerk who originally denied them has filed a suit against the governor of Kentucky for violating her religious liberties by ‘insisting she issue marriage licenses to same-sex couples’. What an entitled asshole.

      Beyond being compelled by Court order upon application by the gents trying to get married (a lawsuit or Order to show cause) to issue the license, he or she might face a charge of contempt?

      In addition, the couple could file a lawsuit against the County for damages related thereto, although it would be difficult to put a number on it. They shouldn’t sue/wouldn’t be able to recover from the individual because it’s the County’s responsibility to provide services to the public.

    Worth noting from an earlier story

    Davis, elected last November as a Democrat, took over the office from her mother, Jean Bailey, who served as county clerk for 37 years, according to the Morehead News. Davis worked under her mother as a deputy clerk for 26 years. (Deputy Clerk) Nathan Davis refused to say if he is related to Kim Davis.

    See, this is why I’d never be able to be a politician. I’m a “scorched earth” kind of guy- somebody in that Kentucky office denied a gay couple a marriage license? EVERYONE in that office loses their jobs. No exceptions. With that in the realm of possibilities, when one religious nut job squeaks about Jesus, the rest of the people in the office will righteously slap that person down.

    Peer pressure, man. It works.

      I know, right? I have quite a few unsavory aspects to my character, and among the worst is that I’m vindictive. I really ache to see this woman and her cronies absolutely ground into the dust, but I accept that these feelings are indicative that I should never seek real power.

      Kim Il Sung was probably just a reasonable guy with really strong feelings, but turn him into the Supreme Leader and suddenly it’s “3 generations of punishment for crimes.” I just don’t need to go there.

    This is a good reminder that rights aren’t equal simply because the highest court finally gets something right. But, the good news is that the Clerk’s office unquestionally broke the law; they have the video proof of the violation; and even a so-so lawyer should be able to file a suit for a prelminary injunction for a license and thereafter get a quick settlement to help fund their honeymoon. That doesn’t make this acceptable or make them whole, but suing the balls of biggots is the next step after the Court give you rights.
