“On Call” scheduling should be illegal except in certain, industry-specific instances. It’s a just a means for a company to minimize their labor costs at the expense of their workers well being. The workers can’t work a second job if needed (and it usually is if you have an “on call” type job), can’t plan family and social events, have serious trouble arranging for child care, and so on.

One more reason to FUCKING UNIONIZE!

I’d even be willing to exempt small businesses in, say, their first two years of existence. After that, figure it out.

I was thinking more along the lines of people who work as healthcare and other emergency personnel, or in position where unforeseen “emergency” type situations requires someone to be on call.

I worked in the concession stands of a sports arena for a short while in college. Initially, they’d call everyone in several hours before an event, then pick from among the crowd who would work that night. The rest would go home. We were a union shop and I was initially annoyed that part of my first check went for Teamster dues. My attitude changed when the union had a chat with the managers about the cattle calls. After that, anyone who was called in to work was guaranteed at least $20 each for showing up. Amazingly, the managers suddenly were able to fairly accurately decide how many employees would be needed for the stands on a given night based on projected attendance.

The fact that the wealthy rulers have convinced most of the working class that labor unions are bad for them rivals any successful propaganda campaign in the history of mankind.

People tend to remember the bad more than the good. There are/were plenty of bad unions but more useful and effective unions get forgotten

Has Abercrombie also pledged to stop deleting posts that are critical of a company that outs gay men?

Makes sense. Ultimately it was probably not really saving them that much money, and the optics are obviously terrible.

Oh it can save them a bunch. My high school aged daughter works at a movie theater and is on call all the time. They wait and see what the weekend day or night is projecting to look like based on internet ticket sales and so on and then call in people as needed. It’s just the money they save by not having to staff on slow days, it’s the money they save by never being over-staffed. It adds up to HUGE dollars.

But how much does your daughter make for those shifts when she goes in?

$75 on the high side? The “on call” group is going to be, at most, a few people.

Manager: We are having a clothing emergency and I need you to bleed for this company.

An employee probably named Trysten: Yes. My blood will flow for these brushed cotton athletic fit tees.

Manager: If we sell more clothing, the regional manager will come and spray us with his cologne samples.

An employee probably named Tryndyn: I seek the boon of the Regional Manager, as my father did before me.

This is completely outside the responsibilities of the president, or any politician. Where in the Constitution does it say “the president is allowed to ban on-call scheduling?" This is a private matter between private employers and their employees, who took the jobs voluntarily and can quit them just as voluntarily if they don't like the terms of their employment. Jackass.

Exactly. While we’re at it, we should get rid of minimum wages and safe working environments. That’s a private matter too. Finally, we should allow employers to require employees to sign employment agreements that have covenants not to sue for anything. After all, they can find another job that doesn’t have that if they don’t like it. I’m sure it won’t become a standard like arbitration clauses. Next time you’re in the DMV-area, do you want to play with my Ayn Rand Somalian warlord, and Laffer action figures?

Article I, Section 8 permits the federal government to regulate commerce, so you know, this. 1905 called, they want their Lochner jurisprudence back.

When I worked in retail, assistant managers would close one night then open the next. So leave at 10:30, back at 8. Or during the holidays, leave at midnight, back at 7. The store manager strangely never had to do that.

The AMs complained and then the district manager had to approve the schedule.

I don’t get why retail companies pull this kind of scheduling shit. It just burns people out and increases turnover.

good thing for a presidential candidate to promise, and then do.

The funny thing about this is that almost every campaign and political organization have absolutely horrible standards when it comes to pay, hours, scheduling and other employment issues.

Someone a few years back wrote of their time at some left wing organization (OFA or MoveON.org maybe) and how he was pressured to work over 12 hours a day for minimal wages, all while pushing policies that demanded others treat workers fairly.

This is very true. Pretty much every campaign, those of liberals included (I have no idea about Bernie’s organization but certainly OFA), expects and demands massive amounts of unpaid overtime even at this stage in a campaign, and by the middle of the election year it’s 100 hours a week for a fairly low static salary. Hence why so many of said campaigns are full of early 20s idealists who burn out quickly and get churned through.

Banning this practice would be a good thing for a presidential candidate to promise,

Every candidate: “No problem, we’re on board!”

      and then do.

      Every candidate:

It should be made illegal entirely. Not sure how the restrictions work in the US, but in BC at least, if you’re on welfare and you are offered an On Call job, you must take it or you lose your benefits. Unfortunately, unless you earn more than $610 (the monthly welfare rate) ALL of your money is deducted from your welfare cheque. So you can potentially earn negative amounts, once you factor in taxes, transportation, clothing, lunches, etc. NEGATIVE AMOUNTS. And if you get called in to work, you must go, but if you get called in when you have a conflicting welfare appointment, and you go to work, you miss your appointment and get cut off welfare. If you say no to work that day and go to your appointment, you get cut off welfare for saying no to work. And workers who are on casual status are on that status for more than six months, on average, so basically unless you simultaneously get two or more different casual jobs, you cannot afford to work.
