      If the previous UVA suit against ABC agents is any measure, he’ll at least get enough (over $200k) to cover his entire undergrad career. Now, considering the previous suit didn’t involve being assaulted to a bloody pulp and shackled like a slave, I’m hoping he’ll at least get $500k for his “troubles.”

      ETA: “” to make it clear that troubles is obviously a very inappropriate and under-deserving word for what the man went through.

    We have turned into such a police state that there are actually people employed by law enforcement to literally police college kids walking into and out of bars. Yeah, this isn’t exploitive bull crap. A division of law enforcement, not funded to capture rapists, gang members, murderers, home invaders, gang bangers, bank fraudsters... Nope. Go get that college kid that is old enough to die for our country and kill for our country but she/he is not old enough for a beer or they are possibly intoxicated. This is getting out of hand.

      It’s not just college kids. ABC folks monitor bars all over. From what I’ve heard they even occaisionally visit the dive bars in the next town over from me and the only thing they have are a couple trade schools (no real campus or housing and a good portion of the students are legally able to drink).

    So only tangentially related but why do towns want agents of the state government just prowling around and making arrests in the first place? I mean they wouldn’t want State troopers giving speeding tickets when their own police already do.

    Also what the hell is there justification for beating him. From what I remember he didn’t attack them or anything. Even if he tried to run shouldn’t they be limited to subdueing and cuffing him?

      Most Virginia resident’s don’t want them. There have been several attempts to disband the ABC police force but the extremely conservative General Assembly keeps shutting those efforts down. Everyone was hoping this would be the incident that helped but ... Pipe dreams. We have them.

      They didn’t beat him. He doesn’t allege they beat him. The video doesn’t show them beating him.

      They arrested him, albeit violently, and in the process he was thrown to the sidewalk where he scraped his head (visible above) and began bleeding from it. That’s it. Perhaps they should have been more careful but calling it a “beating” is supremely dishonest from Jezebel (who has not actually referred to it as such previously).

    Of course there are no charges against the ABC officers. Virginia is a fascist state. I’ve practiced law there and seen it up close.

    I wish this kid could sue in Federal court. I’m not sure he can. The Virginia courts would be a waste of time. I don’t know, maybe he just wants to go on with his life, but it’s fucking infuriating that they could treat him this way and get away with it

      Two ways into Federal Court: (1) Federal Court Jurisdiction. If your case is based or arises under any Federal Law. (Examples: Civil Rights Violation, State Law Conflicts with Federal, Patent, Bankruptcy, etc.); and or (2) Diversity of Citizenship. One party must have citizenship or a primary place of business in a different state then the party where the cause of action is filed. And the amount in controversy must be for at least $75,000.00 or more.

      Should he choose to file a cause of action for civil rights violation(s) then jurisdiction appears to be appropriate with the United States District Court, Western District of Tennessee, in the 6th Circuit. He could always sue in State Court, but that would be silly. For your stated reasons, if true. Also, if he has any other claims that may have only been permitted in the State’s court, he can piggy back those claims onto his Federal case.

    This violence against unarmed black men will not stop until police officers are held accountable by actually serving prison time. I don’t care about cops and body cameras. I don’t care about cops charges pressed against them. I want CONVICTIONS. This young man was assaulted and the assailants should be convicted.

    Every time I read about this, I think about how it could be me next. Doing nothing but minding my own business. Assaulted by cops. Watching them live life unpunished.

      UGH this kills me. I’m a 19 year old white girl who also attends UVA and I’ve *skipped* into that exact bar showing a really shitty fake and was let in with a chuckle. It kills me that someone, especially someone as accomplished academically and genuinely nice as Martese, was treated this brutally by the ABC for something the vast majority of UVA students do blatantly because he’s a black male.
