      The linked NYT article explains the decision a bit better:

      “Though Ms. Menendez had been deemed competent to stand trial, “at trial there would have been open questions and gray areas that may have resulted in a hung jury,” Kevin R. Ryan, a spokesman for the district attorney’s office, said in March.”

      As a practical matter, the defense to a homicide charge would be that due to her psychiatric and drug history, she wasn’t capable of forming the requisite mental state to kill the person. The manslaughter charge doesn’t have the same mens rea hurdle that the homicide charge would carry. I think it was smart to go for the sure conviction rather than risk a not guilty- insanity verdict. Too many prosecutors go for the home run and end up swinging and missing.

      ETA- I do think that she was capable of forming the mental state to kill that man and knew what she was doing, but I don’t think it would be a slam dunk in court.

      ‘The Queens district attorney’s office, the New York Times reports, accepted Menendez’s lesser manslaughter plea—and did not pursue a murder charge—because of her “substantial psychiatric history and drug problems.”’

      It sounds as though she had therapy, but obviously it wasn’t effective in preventing a racist asshat from acting like one.

    I’m kind of over the “it’s a tragic situation all around” response when someone suspects a criminal of being mentally ill. Not all decisions by a mentally ill person are completely caused by their illness. I know many people with drug/psychiatric problems who aren’t racist killers. I’m not sad for this woman, who killed a man in cold blood for something he (and his religion) had nothing to do with.

      Right. Like, why am I sad for HER? She made a choice to end someones life for a stupid reason. She got her punishment, I’m not losing sleep over her 24 years in jail. I’m sad for the man and his family. In a split-second, he went from living his life to being violently killed. He is the one who deserves our sympathy.
