    Before someone says that there shouldn’t be a defamation lawsuit against Rolling Stone because a rape obviously happened, just not this one, let me ask you a question: If you’re the parent of a high school junior (or senior, although seniors have probably picked their colleges already), would you want to go to this school if you read this story? Would you want to bring any problem in front of this woman who you have been told doesn’t care about the victims of sexual abuse? If the answer is No, that’s why the defamation lawsuit should happen.

    Also, no good outcomes here. I hate the idea of the defamation lawsuit as another hurdle for rape survivors (of which i am one, in full disclosure), but I also deeply dislike the way Rolling Stone handled this.

      Defamation won’t be a hurdle for rape survivors - it will be a warning for journalists who don’t even try to talk to alleged rapists, or check with fraternities for something as simple as when their parties are. If I understand the law correctly, it’s not even an issue for journalists who make a good faith effort to do this kind of fact-checking. Just people who think that journalism should be a safe space for survivors, where no one ever even doubts or checks stories.

      Edit: and that’s all on Erdely, in case that wasn’t clear. She even went so far as to bully the survivor to publish when she wasn’t sure about it, from what I remember of the story.

      Eramo wasn’t a rape victim. She’s not being sued by her alleged attacker. Her job included working with victims of sexual misconduct. We DON’T want people to avoid that type of job for fear that they might be the victim of a false smear campaign. It’s already not a fun job - disturbing events + the fact that either side could sue the university. And on top of that you’d want someone who’s not callous but empathetic. If people think that signing up for this role makes you a target of attacks that you can’t defend yourself from, no one is going to want to do it.

      By all means, criticize universities for handling things poorly, and if you need to point the finger at individual top level administrators, so be it, but only based on what they actually did or didn’t do. And unlike a rape, dealings with administrators is something that can be easily documented and verified.

    I dearly hope she wins this. If the NYT this week showed us what kind of good well done journalism can do (through their nail salon piece), the Rolling Stones & Erdely in particular has done nothing but harm to their brand, to UVA and its community, and to the feminist movement in general by shoddy work.
