“Day-to-day life is unbearably stressful, as Emma and her mattress parade around campus each and every day,” Nungesser’s complaint reads.

““Day-to-day life is unbearably stressful, as Emma and her mattress parade around campus each and every day,”

To be fair, men are extremely emotional creatures, what with their hormones and all. I thought the male body has a way of shutting all that stuff down.

As we reported in February, Nungesser was found not responsible in the alleged rape by the campus disciplinary board. Two other women also accused Nungesser of sexual assualt; the board found him not responsible on those charges as well. Another accuser, a male student, says he filed a complaint against Nungesser with a campus organization they both belong to, and a Title IX complaint against the school.

What a weird series of coincidences poor Mr. Nungesser has fallen victim to!

There should be a correction. In one of the three cases brought by women, he was found responsible. He appealed, and the complainant could not attend the hearing since she had already graduated, and so those charges were dropped. Dropped due to a scheduling technicality that Columbia didn’t seem to care about.

“I think it’s ridiculous that Paul would sue not only the school but one of my past professors for allowing me to make an art piece. It’s ridiculous that he would read it as a ‘bullying strategy,’ especially given his continued public attempts to smear my reputation, when really it’s just an artistic expression of the personal trauma I’ve experienced at Columbia. If artists are not allowed to make art that reflect on our experiences, then how are we to heal?”

Look, I’m all for accusing your rapist but don’t try to go, “But it’s art. No, really. It’s art.” It’s not. It’s your attempt to get justice through harassment. Everyone on that campus knows it. Hell, that’s what you were saying it was about in the first place. And now it’s backfiring. I feel sorry for you but don’t try to bs your way out of it.

The moment I heard about this story way back when she started carrying the mattress around I knew, just knew, that this was going to be the outcome. I only wondered how long it would take before a defamation and or a harassment lawsuit was going to be filed.

On a side note, is Nungesser even American? If this guy is such trouble, which given his track record, it seems he is, you’d think it would be easier for the school to get rid of him and be able to get him deported than if he was not American.

I’m guessing you had to commit a crime or otherwise violate a specific term in your student visa to be deported.

You can’t really just strip all art of its social and political value. Was Picasso trying to get justice through Guernica? Yes. Does that mean he was “harassing” the Fascists? No.

Emma has never named her assailant so her art project in no way counts as “harassment.” The only way Paul Nungesser’s name got out into the media was when he started reaching out to reporters; he revealed himself as the person who has been accused by three women and one man of sexual assault. Now he realizes — even though he hasn’t been convicted of anything — there is a damaging google trail on him of his own making. He figures the best way to make some money is to throw a hail mary law suit at the institution with the most money — Columbia.

“Not responsible” isn’t necessarily an exoneration, am I reading that right? Like “we’re not saying he didn’t do it, but we’re not NOT saying he didn’t do it.” It’s confusing wording, but perhaps that’s intentional?

Also, there’s this, from the first linked article:

He’d earlier been found “responsible” for another sexual assault, but had appealed and won after the woman grew tired of fighting the proceedings. So he was allowed to remain on campus.

Let me get this straight: she never brings this guy's name into her work, he is never punished by the University, and now he is putting his name into the public record, in court documents, as the accused rapist? He wants to go to trial (he won't get there - this case is dead in the water, but still), where the details of what happened with Emma and the others will be discussed and again, be part of the public record? Is his lawyer trolling him?

No. First, slander is not a criminal offense. It is a civil claim in which someone has to show actual, not speuclative damages. Second, because being found “not responsible” by a private university’s administrative board does not have any legal bearing on his guilt, and does not prove he didn’t do it.

Well he hasn’t been charged by the DA of anything. Can I just stand outside your work and home and accuse you of raping me? Can I walk around the streets and choose random black people to accuse of being thieves and hold up signs for days calling them criminals when they’ve been charged with nothing? I always wondered who would learn nothing from the repeated forced teachings of the Salem witch trials growing up and I guess it’s all of jezebel?

The chutzpah of this asshole is incredible. Columbia is discriminating against you based on your gender because they won’t stop women from protesting against the problem of rape and sexual violence on campus and the university’s poor response to it?!

Try being a rape victim, having people question whether or not you “led him on”, “dressed provocatively”, “changed your mind”, etc., being harassed by your rapist and his friends, and having the justice system and university either completely fail you or actively work to protect the rapist. Then try having the university do everything they can to protect their precious enrollment numbers by actively working to try and block your message that there’s an issue of sexual violence on campus that’s being ignored.

This guy needs to go sit on a cactus pantless.
