    I am so confused by the RS story and the convoluted coverage the story itself received that, at this point, I need to see some kind of fact sheet in a timeline format to make sense of it all. Anyone else wanna get in this boat?

      Quick Rundown:

      Everything regarding the systematic silencing of complaints at schools was true.

      Everything specifically about the “Jackie” story was either made up or unsubstantiated.

      No facts were checked, no sources were questioned beyond Jackie.

      All fact checking post article drop illustrated only inconsistencies. These inconsistencies were major, discrediting pretty much that entire portion of the article.

    I can’t recall one story of a woman who reported a rape, her rapist was accused, and justice was served. Meanwhile any time a woman ‘makes it up’ there are thousands upon thousands of articles wherein people can showcase their vicious misogyny in the name of vindicating those innocent men.

    As a woman who has experienced sexual assault, all this UVA stuff proves to me is how I shouldn’t ever mention my assault since my case isn’t air-tight. I can only imagine trying to get justice in this day and age. Not only would I have to relive that shit 100x over in court, but if I lost (which women usually do in these cases), I run the risk of my rapist suing me for defamation and I could actually go to jail.

      Defamation is a civil lawsuit. Rest easy - you can't go to jail for defamation. He could just ruin you financially.

      Ahh I see. I couldn’t remember the actual reason why women were being put in jail for ‘false accusations’ - http://www.theguardian.com/law/2014/dec/0... - guess the real reason they’d go to jail is for ‘perversion of justice’ or something like that.

    Oh Jesus. What a fucking mess. Rolling Stone’s borderline incompetent reporting here is shameful and their subsequent arrogance and complete unacceptance of blame (“Let’s blame that distrustful bitch Jackie instead) is horrifying. Yet please let us remember that things are not neccessarily mutually exclusive. This country, this world, has currently, and has always had a woman problem. Specifically, a violent fear and hatred of women. Of vagina’s. No jest. As a proud feminist man I support and give my voice in an effort to eradicate this most disgusting evil from society. I am not a woman, I only understand your experiences intellectually, and would never intentionally appropriate your struggle. But I am here, on the side of all women and all those who deserve equality and dignity.

    Totally within their rights to pursue. And yes, this particular piece of “journalism” was a hack job at best, but if I were ANY frat (and hell yes I’m generalizing) I’d be reeeeeeeeeeeeeeally careful about going down this road because the likelihood that nothing suspect or shady or downright rapey ever happened in that house is slim and I sure wouldn’t want to push buttons that could lead to further investigations. Everyone was focused on that one night since the “story” hit but there’s 365 nights a year guys....

      I’m no fraternity fan either, but your logic here is like justifying unfair police stops with “okay, he wasn’t doing anything that time, but the kid looks like a thug.” Luckily our system of laws is not based on what we think somebody might have done at some other time.

      With defamation claims, it's not that easy, though. Part of their claim is that the story hurt their reputation, which means any evidence that they already had a reputation for raping or other assault is fair game.

    We knew what this report would say. Moreover Rolling Stones knew what this report would say and they’ve had months to come up with a statement. All that time and the best they could come up with is “Jackie lied and we totes fell for it. Oops.”

    I’m not a litigious sort but if they’re not even going to pretend to make any internal changes that can insure their reading public that this won’t happen again then bring on the lawsuits.

      Clearly RS made some major errors. But why must everything become a lawsuit? I would have been so impressed if Phi Kappa Psi announced that they accept the apology, asked for a LARGE donation in their name to a Rape Crisis Center paid for by RS. At least then maybe someone would get something positive out of the situation. Now, the only winners are the lawyers.

        They most likely already have lawyers on retainer. The case is a slam dunk and they deserve their pound of flesh or at least refunded for the all the vandalism caused as a result of the article.

        Absolutely, they should definitely receive compensation for the vandalism and a grand apology. Perhaps even a firing of the editor. But honestly, at this point. WE ALL KNOW. No reasonable person is going to hold the fraternity at fault. Instead of beating a dead horse, they have a chance to walk the talk (if they really are in support of true victims) ask for a sizable donation in their name to a national crisis center.

      Magazines have long been cutting back on—if not completely eliminating—fact checkers on staff. This is just another in a long line of horror stories that are the result of those kinds of editorial cuts.

        Yes, RS employs far fewer fact checkers than ever before. And this “dispensible” approach to fact checking within editorial circles—too few (if any) on staff, dismissing their value, the fact checkers themselves feeling powerless, etc.—is resulting in less rigor on the whole.

        I really, really don’t like frats, but I can’t blame them a bit for suing in this case. This specific alleged incident didn’t take place and both the author and Rolling Stone did not look into the story enough of talk to the accused before publishing it. I do like that the frat included the negative effect of this mess on future victims of sexual assault.
