      I know that they're just defending themselves from the lawsuit but a person actually wrote that this innocent child was responsible for his own death, and I find that mind-boggling. I don't know how that person sleeps at night.

    They employed a man who had been previously dismissed from a police force for being emotionally unstable and failing to follow instructions. His former deputy chief wrote in his personnel file: "I do not believe time, nor training, will be able to change or correct these deficiencies."

    We all already know that Tim Loehmann will never face criminal charges, because our justice system values the relationships between DAs and cops far more than it values young black lives. But sweet mother of fuck, if Rice's family doesn't at least win a boatload of money in a civil suit, I'll take to the streets with a fucking pitchfork.

    They gave a demonstrably incompetent person a gun, and he then used that gun to kill a 12-year-old. Fuck them.

      That report on his previous evaluation is scathing, and completely unambiguous. If there were ever an "open and shut" case of culpability of the department for a wrongful death, this is it. Having said that, I don't have much faith.

      The child never had a chance to comply with a demand to disarm that was ( maybe?) given 3 seconds upon too close contact. Why didn't that squad car tell him to drop his weapon over the PA from 100 feet away? Much shame to the City of Cleveland; may they lose this case without appeal.

        Exactly.

        Look at it from a cop's perspective, or specifically a safety one: How was their approach (speeding into a playground, stopping just 2 feet short of a supposedly armed suspect and quickly exiting from the passenger side where the suspect is positioned and startled) condusive to maximizing the safety of the officers while engaging with the suspect?

        If anything, these cops recklessly endangered their own lives with their approach, escalating a situation to a needlessly dangerous level that directly encouraged the reckless use of deadly force on a 12 year old boy.

        Yeah, the whole thing was strange. You are afraid of someone so you roll right up to them and exit the safety of your car before assessing the situation? That maneuver and behavior should be enough to prove negligence on the part of the police department. I still shake my head whenever I see that video because what they did made zero sense.

      Back when I was a kid, we all failed to "exercise due care to avoid injury." I seriously can't believe someone said that about a 12 y/o. I had to read it twice because I thought maybe that paragraph was about the cop.

        Oh god. My brother and I would fire rocks at each other with sling shots. Our tree fort was a total death trap and we would climb trees to the point where they would start to bend over under out weight (I'm talking about 200 foot trees). We also would paint our water guns to look more real.

        Wasn't this kid the one who was sitting in a park with an air soft gun sitting next to him and the cop just pulled right up and opened fire?

        It's a lawsuit. The city is obligated to not just pay out money. I am assuming that due care extends to the parents because dependents are their parents responsibility. I'm not agreeing with their arguement, but getting outraged over a city defending itself in court is ridiculous. The city doesn't give a shit because they'll pass the cost on to the tax payer.
