    Three observations:

    1. It's crazy that people are still touting the "innocent until proven guilty" line.

    2. It sucks that Seth benefits from more hegemonic cred. than the other women. Her status as an educated, middle class, heteronormative, white, married person with kids provided the allegations the kind of picket fence narrative that was missing. But any woman should be taken seriously, including particularly the xoJane author. Too many folks critiqued her for being star struck. And ghomeshi really played up those victim-blaming sentiments.

    3. It's awesome that Seth also casually mentioned that she was smoking pot, thus lending credibility to that practice as well. Because if lawyer soccer moms are smoking it then it can't be so bad, right?

    Is the definition of rape different in Canada? Because any nonconsensual penetration is rape, I thought.

    Regardless. I hope for all the karma to rain down on him that he has coming.

      It is but you'll have a damn hard time convincing a prosecutor to go forward with the case—that's if you can even get a cop to bother taking a report.

      We have Assault, Sexual Assault and Consent laws not "rape" law. So the definition could be a bit different. It falls under Assault first:

      265. (1) A person commits an assault when

      (a) without the consent of another person, he applies force intentionally to that other person, directly or indirectly;

      (b) he attempts or threatens, by an act or a gesture, to apply force to another person, if he has, or causes that other person to believe on reasonable grounds that he has, present ability to effect his purpose; or

      (c) while openly wearing or carrying a weapon or an imitation thereof, he accosts or impedes another person or begs.

      (2) This section applies to all forms of assault, including sexual assault, sexual assault with a weapon, threats to a third party or causing bodily harm and aggravated sexual assault.

      Then Consent:

      266 (3) For the purposes of this section, no consent is obtained where the complainant submits or does not resist by reason of

      (a) the application of force to the complainant or to a person other than the complainant;

      (b) threats or fear of the application of force to the complainant or to a person other than the complainant;

      (c) fraud; or

      (d) the exercise of authority.

      Bolds are mine. Also of note is that intent isn't always required to prove an assault has taken place.

    Now that's it's beyond obvious this guy has been sexually attacking women for years, all that's left is to watch his defenders switch their arguments from "Jealous bitches are always lying about sexual assault / You people don't understand kink / We don't know all the facts!" to "He obviously has an untreated mental condition, poor guy. There's nothing to see here, just a crazy person."

      This is what I'm worried about. Mental health is a serious issue, but I honestly (in my unprofessional opinion) do not think he had a mental health problem that led him to beating women.

      I think he was turned on by non-consent. Which, in the world of BDSM and D/s, is pretty normal. BUT it's consensual non-consent. He couldn't get to that part. Terrifying and disgusting. He also clearly preyed on younger women, probably for a reason.

      Not sure if it's mentioned in another Jez story, but the twitter account @bigearsteddy tweeted in April 2014 alleging Ghomeshi beat young women. The one tweet said "signed, all female Carleton U Media grads" which is my school and my program. The university is now looking into placements that had students at his office or working around him.

    This is why I dig the idea of enthusiastic consent. I don't know about anyone else but reading these account has brought up a whole lot of shit for me. Now its clear that many of these women were straight up assaulted but how many women have had the experience where they were partaking in some consensual sex acts and that it got real rough and it left you confused and weirded out but because you consented in some way, maybe you never even thought it was assault?

      I am so glad this piece of garbage is getting his behavior put on Front St.

      And Bravo to the women brave enough to put their name behind their stories. Not everyone can do it, and I'm not critical of those who can't or won't. There is plenty to be done of value without taking on the additional burden of public exposure. But it is the women who stand up and speak out that get the public's attention on this behavior and this culture.

      That's really scary. And exactly why women should feel comfortable going to the police after any unwanted non consensual sexual assault. Situations like she describe are so sad because it seems like in her mind she thought "I should be glad that's ALL that happened." I think many women have felt like that at one point or another (myself included) and so we hate to be "potstirrers" that go to the police and hospital when we know we'll be made to feel like we should be "thankful it wasn't worse." Fuck that. It's all bad. He needs to locked up.

      So glad she felt comfortable enough to finally come forward. It will help the case against him.

        Yeah, there are a few things happening now that make you realize how terribly the nation's police departments have failed. One is the issues with race. Two is the fact that women are literally scared to report sexual assault to the people whose jobs it is to stop it.

          The Globe and Mail interviewed CBC Q producers today:

          Always lurking in the background were questions about Mr. Ghomeshi's romantic life. None of the staff interviewed by The Globe said they saw any evidence of the alleged violence that has been documented over the past week. But they took notice of the frequency with which Mr. Ghomeshi dated new women. Mr. Tunnacliffe described it as this "weird vibe around Jian and women." Staff also had a code word they used when they were asked to book guests who they suspected had slept with Mr. Ghomeshi, Mr.Tunnacliffe said.

          One staff member, who agreed to speak on the condition of anonymity, said one question she has repeatedly faced since the scandal erupted is how the voice on the radio, who portrayed himself as a feminist and sensitive, can be accused of such things. Her response was simple: He was often "reading other people's words."

          This is why people need to think, if someone has a weird vibe around women, how does it not become an issue? How does it continue? Because we can't realize or confront work environments toxic to women, especially when there's a male celebrity or executive involved. You put aside things that otherwise tell you "this guy is a misogynist and possibly worse."
