I can't decide whether this is inappropriate because Paul is personally opposed to marriage equality and has repeatedly stated that he would have voted for DOMA had he been in Congress at the time, or extra appropriate because using his likeness to celebrate this is a great "Fuck you" to him.

More important is that this effectively legalizes SSM in the other states in those circuits, including South Carolina. I look forward to reading about their outraged reaction. It will be delicious.

I've seen that in a lot of IANAL-type posts, but never in any of the official news around this potential lack of action from SCOTUS. Is this an absolute certainty, but the implications are still getting sorted out?

It is a near-certainty, in that there may be no court ruling directly on point yet, but the any gay married couple that sues for legal recognition in South Carolina is going to win on precedent alone.

Arguably, its a stronger message if each of the 13 circuits come back invalidating a State's ban on same-sex marriage.

Arguably yes, but hard to imagine that will actually happen. Some Circuit's gonna be the asshole they want to see in the world.

If they're busy, I think the 6th is available, and I'll bet the 11th is just dying for a call.

They won't be. The Fifth Circuit will never pass on an opportunity to shit on people.

Isn't it pointless to be against gay marriage at this point?

It eats up the legislative timetable so that democrats are unable to focus on other meaningful reforms. It's Rove-era strategy incarnate. It's an emotional issue that progressives can't abandon- but it's at the expense of tax code and financial reform, criminal justice reform, fighting poverty... you know... the big underlying problems in our society from which rich people benefit.

Only if you don't want to marry your gay partner, I guess.

It clicked for me a while back.

No elected republican actually cares about gay marriage. They care even less about abortion. Even less still about contraception.

It's a political strategy. They've succeeded in hijacking the dialogue from what we should be talking about- essentially moving the goalposts backward 30 years. So while we're stuck in the marsh, endlessly talking about this, we don't have the legislative capacity to advance our society in other ways.

    Really shameful.

They knew they couldn't possibly have nearly as much fun with it as they might have once they heard Posner beating them to the punch.

My favorite thing about these reversals is that they started as a Republican attempt to oppress LBGT people and ended with the opposite effect.
