    I've maintained from the beginning that any gay marriage case that gets to this Supreme Court will side with marriage equality, and I've been proven right over and over. Unless you think one of the four liberal justices will swap sides and vote against marriage equality, it's basically a done deal. Kennedy has authored the decision on all three of the major pro-marriage equality decisions — I can see no reason he wouldn't continue that (especially since on the Prop 8 case, he was one of the judges in the minority who wanted to try the case, and he made it clear in Windsor what his opinion was).

    Marriage equality is pretty much the only issue on which Kennedy sides with the liberal wing.

      Kennedy was the main reason Bowers was overturned (with Texas vs. Lawrence), he has been very progressive whenever it comes to gay rights issues.

      I honestly think that unless a court rules in favor of a ban, SCOTUS is just going to decline it on a case-by-case basis. Which is a shitty, passive-aggressive thing to do, but hey, at least Fox News won't accuse them of being "activist judges!"

    God, this is sad. I know we're still "evolving" on same-sex marriage, and all that bullshit, but why are people still "deeply uncomfortable" at the sight of two individuals who love each other willfully submitting to the power of state laws to validate their relationship? There are so many other things to be uncomfortable about, so many other things to molest your pearls over. Get on Twitter and look at Ferguson if you want a worthwhile cause to fight for. Fucking get out of our love lives. Shit.

        Please tell me I am wrong but I have deja vu to 2013 when the Supreme Court put a block on a nursing home run by nuns because of the Birth Control Mandate in the ACA I remember writing on Groupthink that this was a bad sign for the mandate. I have the same feelings again for same sex marriages. Tell me I am wrong and there is no comparasion.

          I don't think this is a bad sign at all. Putting a stay on a lower court's ruling is par for the course, so I think the Court will take the case. I also think same sex marriage bans will be declared unconstitutional, with Kennedy as the swing vote. Many if not all of the judges declaring these bans unconstitutional have been quoting language from Kennedy's opinion in Windsor. I just don't see him doing a 180 so quickly.

          The Supreme Court has been waiting this one out to see what direction appellate courts would go in; which so far has been in favor of gay marriage. The end result of this decision could be the SC striking down all marriage bans in the rest of the country all at once instead of state by state.
