    Meanwhile there's 950 same-sex couples who got marriage licenses in Utah, and most of them actually went and got married before today. As much as I wish it didn't affect them, I predict Utah is going to announce those marriages will be "unrecognized" until the supreme court makes a final decision next year (its too late now for an argument and final decision during this years' scotus term). The only precedent for this - marriage rights being taken away - is CA right after prop-8 passed. In that case, CA continued to recognize the pre Prop 8 marriages, but it took a decision by the state supreme court to validate that position, since the other side was arguing for their invalidation. And that was with Jerry Brown as the AG. Utah is WAY more conservative than the California state government in 2008, and will push hard to deny recognition (if not completely "invalidate") the marriages performed before today's stay. They can get around the ex post facto argument by saying the now-enforcable anti-equality amendment in the Utah Constitution (amendment 3) prohibits the continued recognition of those marriages, even if the temporary recognition of them before today was valid.

        Utah didn't soften its laws on marriage in the polygamy case. It was their illegal cohabitation law that got struck down. Its still illegal in all states to attempt legal marriage simultaneously to more than one person. This all stems from our poor definition of polygamy - does it mean carrying on an unrecognized marriage-like relationship with multiple people, or actually attempting or fraudulently obtaining multiple legal marriages?

      Unfortunate, but completely expected. Hopefully scotus will address this on a national level officially, instead of simply coming along afterwards to clean up state level issues.

        Yeah, I am hoping for this too. I think the district court's opinion was based at least partially on the unconstitutionality of same-sex marriage bans because 14th amendment, but also cites the US v. Windsor which was decided on federalism grounds. If I am reading this correctly, that is the crux of this appeal http://equalityontrial.com/2014/01/06/sup…

      If I remember, the 10th circuit is fairly conservative court. My guess is that they'll overturn, it will go to SCOTUS and they wont grant cert.

        I'm naive as fuck so someone lead me here. What is it to others if gay partners can get married? I've never had the urge to get married and I don't understand it but I've never been like, no, those straighties need to go somewhere with that bullshit marriage whatever. Mainly because it effects me like 0% and also that it's not my business what 2 people do to each other (porn not included). I'm sure it can't all be religious reasons. I feel like we've evolved a little from that, no? Not talking to you Mississippi. SOMEONE HELP ME UNDERSTAND!!!
